You should have an employee handbook that lists that information for your specific position. If it is a 7 hour day, since it is over 6 hours you get a 30 minute (unpaid break) and two paid 10 minute breaks.
If it is a 9 hour day, sometimes you will get a one hour lunch (unpaid), and then you have the option of taking 2 ten minute breaks. Hope that helps  |

Thanks the lady that did orientation told us but she went fast and I figured it didn't apply to me since I was part time. However they want me to get in from 7 to 4 for training.  |

In CA, if you are working 5 hours minimum you MUST take a break, 30 mins. It's not paid. If you are working 8 hours, you get like a 10 or 15 min unofficial (don't clock out) break. That's how it was when I served tables. I'm a teacher and get 15 min paid break that I could work thru, 45 min unpaid break for lunch that I have to take and I work 4.75 hours paid for that. If they had you sign a waiver, then technically you don't have to take a break cuz you are choosing not to take it. But ya it depends on where you work how they go about the breaks. The handbook or HR need to let you know.  |
