Would this be insurance fraud, and any suggestions would be greatly appreciated.

As I am sure everyone knows, I have Psychos for neighbors that I have to deal with. Over the summer, they were cutting grass and broke 2 glass panels on my sliding glass door. They refused to pay to get the door fixed, so I took them to the local Magistrates. He told them they are responsible for the costs of repairs to the door. IF they didnt like his decision, they had 30 days to appeal,BUT the same day as the hearing, they put 2 "notes" in my mailbox, after the hearing. The first note stated: Here is the 123.00 I owed you for the court costs. Once your contractor makes the repairs to the door, Please have him contact us directly, and we will pay him for the repairs.

The second note stated: Disreguard the first note. I contacted my insurance company. They will be issuing you a check for the repairs within 10 days. I found this odd since, they wouldnt tell us who their insurance company was, and when we went to the Magistrates, the judgement was against them ONLY, not the insurance company. Well, on the 29th day, I received a Certified Letter from an Attorney. I opened it to see what it was for. My psycho neighbors had filed an appeal against the Magistrates Decision, and they WERENT paying to have the door repaired. The Certified Letter I received was from the Insurance Companies Attorney. He is suing me on their behalf for making false claims to the Magistrate. I DIDNT know how he figured I was making false claims. I never contacted the Insurance company. They are the ones who got the Insurance Company involved, After The Fact. Well, I filled out the required paperwork for the appeal at the Court House. I submitted it immediatly, since this attorney only gave me 10 days to file the appeal paperwork, where the Magistrate gave them 30 days for the appeal.

Yesterday, I get another Certified Letter from the Insurance Companies Attorney. This "New Letter" states he wants a "Trial By Jury" for a 1400.00 door replacement? The Letter states "New Evidance" has arisen. The New Evidance being: I call the neighbor everyday and leave nasty messages on her machine, I make threats to them, and they have me on recording making threats to them. They never paid me the 123.00 Court Costs, They never put notes in my mailbox, ect. I would love to know how they have me on these so called "recordings", I havent seen or spoken to them since the Magistrate's Hearing. I dont even have their phone number.

This "New Letter" that I received yesterday from the Insurance Attorney states: They want a Trial By Jury, (Like I said for a 1400.00 door replacement), Once they win, they expect me to sign my house and my property over to them. The contents of my house and my vehicles will be sold off to cover the "Court Costs" and "Trial By Jury" Fees. I must of read that part 15 to 20 times yesterday. I was thinking to myself: For a 1400.00 door, you want me to sign my house and property over to you, and sell the contents of my house and vehicles to cover the Court Costs and Trial By Jury? NONE of this makes ANY sense to me. My PSYCHO Neighbors are the ones who are committing Insurance Fraud by getting them involved in the first place. The ORIGINAL judgement was against my psycho neighbors ONLY. NO WHERE was the insurance company mentioned in anything that I submitted. So, WHY the Insurance company is even taking this case is beyond me.

I HAVE spoken to my own attorney, and I actually have a second meeting with him today to show this "New Letter" to him where they are asking for a Trial By Jury, they want my house and property, they want me to sell off the contents of my house and my vehicles to get the Court Costs and Trial by Jury Costs. I am at Wit's End Over this entire ordeal, and none of it makes sense to me. I told the Insurance Company Attorney that THEY ARE the ones who got you involved. They are the ones committing Insurance Fraud by getting you involved. He doesnt want to hear it. I dont know what to do??

It would lead directly to bankruptcy court where all this would come to light and hold your neighbors even more libel for this. This insurance company is laying out a bunch of scare tactic BS to get out of paying anything but the cost of a couple of threatening letters. Don't let them get to you and talk with your lawyer and stay calm.

I'd say relax, but I totally get why you'd be worried, confused and upset....I would be too.

He WASNT AWARE that THEY are the ones who involved the insurance company. They told their attorney I AM the one who involved the insurance company. Its a whole new "ball game" now. And YES, Apryl, My town IS FILLED with LOONS.  
Date: 1/10/2014 8:29:00 PM  From Authorid: 12876    wow, for the record when something like this occurs , tell whoever calls if not your attorney, excuse me I do not meran to appear rude but do not know who you are or why you are calling me, immediately contact your attorney and ask how you should handle it, seems that these people likely got a check for repairs to your door claiming it was their house then the truth was found out and you got caught in the middle
