Should it be legal in any state for someone to ride in the back of a pickup truck?

There was an accident earlier today in Guntersville, AL. There were multiple people riding in the back of a truck, when it blew a tire causing the truck to skid out of control, and over the center median. It struck another vehicle and turned upside down. Surprisingly, despite their being 9 people in the truck (unknown how many in the car it struck) there's been only 2 deaths (so far). These were young people from what I read. UPDATE: A third person has died of their injuries

Anyway, that brings me to the point of this discussion. Should it be legal under any circumstances to allow someone to ride in the back? Ironically, if someone were in the cab they would be required to wear a seatbelt. But in the back where there is nothing whatsoever to protect them, they are allowed without restraints..

Only certain states allow this:

Thirty states and the District of Columbia have laws against riding in the bed of a pickup, but Alabama is not one of them. Tennessee law does not cover children aged 12 and older riding in the truck bed or children ages 6 to 11 years old riding in the truck bed off an interstate or state or county highway. Georgia law allows anyone aged 18 and older to ride in the truck bed. But anyone aged 17 or younger is allowed to ride in the truck bed only if riding off the interstate. Alabama and Mississippi are among the states without specific laws covering riding in truck beds.

I copied and pasted the laws from one of our local news sites, so don't know what the states laws are outside the south. The highway where the accident occurred (Hwy 431) is a major highway interstate. Very busy road, far from being some back country dirt road. I don't know why anyone would ride on an interstate in the back. But it's not illegal there.

So what's your opinion? I think Alabama and these other states need to pass legislation, at least on the major highways. I see people on my road (rural area) flying by with kids in the back all the time. If people would go a cautious speed it wouldn't be as big an issue. My dad drove us to the creek and around with us in the back when I was small, but we're talking country dirt roads, and him going slow. But I can't see any reason people should be flying by at 70mph with kids in the back. Very dangerous! So sad for these kids in the accident today, I hope everyone else makes it.

Date: 7/14/2013 6:15:00 PM  From Authorid: 42945    Commonsense should prevail in my opinion...it is illegal over here in Australia to have anyone on the back of these vehicles..on private properties away from public roads, kids in rural areas usually do ride on the back..

I guess you don't care to venture into debate. I don't usually venture in here myself. Worst case scenario, I look like an idiot. Oh well, it wouldn't be the first time!

As to your comment, I tend to agree. I'm undecided if it should be a total ban. That would be safest. But I wonder if that would be too much of a nanny state scenario..

No matter how careful one drives, things can happen...drunk drivers, speeders, reckless drivers, road rage, not to mention those times when debris and other loose objects become dangerous projectiles from other vehicles slamming on brakes, etc. Trucks have a high rollover rate...someone bumps your tire at just the right angle and you start a roll, and anyone in the back of the pickup is thrown and maybe even crushed. Common sense dictates that if it's the law you have to wear seatbelts in the front AND back seats, and since there's nothing to protect a truck bed passenger, there should be no passengers in the truck bed. I feel like it SHOULD be a Heavy Fine, and an Endangerment Charge for the driver, and a Heavy Fine and Reckless Behaviour Charge for the passenger.

Case in point: My choir director in High School told us of a time he took a group of teenagers from his church out caroling during the Christmas season. In the group were twins...brother and sister...the bpu was aggravatomg his sister and, finally, in exasperation she very vehemently said 'I wish you would fall off trucks and die!' 15 mintues later, the truck hit a bump just as the boy stood to go sit in another spot away from his sister, the boy fell out and the back wheel rolled over his head, killing him, just that quick. Trucks have a high rollover rate. One time, my daughter was awakened at 2:00 am by a big commotion in her front yard. When she looked out the window police were all over the place. Her house is on a corner, and a truck came around the corner a little too fast rather than slowing down and the truck careened and then went into a roll, knocking out her brick mailbox and landing on it's top in her yard inches from her car in the driveway. The driver was badly injured and later died. Had anyone been in the truck bed chances are they would have been badly injured or killed. SUVs have a high rollover rate. Same daughter was driving down the feeder of I-45 on her birthday a few years ago Beechie had just turned 2 years old. Both of her kids were in the back seat strapped in securely. Some lady came out of a parking lot a little too fast, without looking, and bumped the front passenger side tire. Sent my daughter's SUV into a rollover 3000 feet down the highway with the SUV ending up on it's wheels in the median. They had bumps and bruises, but no serious injuries, and all had therapy for PtSD. Had it been a truck, and anyone riding in the back, it would have been fatal for the passengers. Flying Debris: 2 cases: A friend's little 3 year old girl was struck through the brain (she survived, but is seriously mentally challenged, now, because a truck with pipes in the bed got into a wreck on the highway in front of them. My friend slammed on her brakes, but a pipe from the truck came flying through the air from the sudden impact and went rhrough the windshield at such an angle that it struck the little girl in her carseat in the back seat. And you know those dings you get in your car and windshield that comes from the gravel truck that passes you on the road or is driving in front of you? Imagine being in a truck bed and having that little piece of gravel hit you in the eye. If it's traveling at enough speed to ding the windshield and car, what will it do to soft tissue? Add drunk drivers, speeders, reckless drivers and road ragers to the mix and you've got a deadly cocktail there...so no...it should be totally against the law to transport passengers in the back of a pick up truck for ANY reason, and should come with Heavy Fines and Charges for anyone breaking the law.

This would be the end of hayrides unless you dont drive off your property. Most of the ones around here drive all over the secondary roads And what about parade floats, surely it wouldn't affect them.

Date: 7/15/2013 6:48:00 AM  From Authorid: 21435    I happened upon an accident some years ago. A small pickup truck lost control, spun around a few times and slammed into a large red oak tree. One of the children riding in the pickup truck bed (a boy of eight years) ended up between the pickup and the tree during impact. I went through the motions, but there was nothing I could do. The child was crushed and he died in my arms. I doubt I will ever forget that. So, I have to say that there is a danger putting anyone back there, especially children.

It's an unnecessary danger. One of the links I posted involved a toddler being thrown from the pick up bed. I realize
it possibly won't happen to you or anyone I know or anyone you know, but why take the chance to begin with? Once, when
I was visiting my Aunt in Arkansas, they decided to get a pony. I was elected to stand in the back of the pick-up on the
long drive home, and hold the halter of the pony, while trying to hang onto the truck. Nearly lost my balance several times
as we went over cracks and bumps. I was on edge, and the pony wasn't happy about it, either.
Kronk, that is awful. I am so sorry for that little boy, and I'm sorry you had to experience it.

I can't name how many times I've seen like 20 kids on the back of a flat trailer with their legs dangling over near the wheels. Granted, they are going 5 mph, but those wheels will still crush you. Their should be more attention made to safety. Back to the pickup bed debate: Isn't it ironic that we have kids in booster seats until they are 6, but when they turn 7 they can fly down the interstate in the truck bed?

Due to overload and lack of safety precautions on the road, people have lost their lives. I believe that it is very dangerous to have anyone on the back of such vehicles. I've not heard of it being illegal here in Tanzania though. People here are very particular about speeding and traffic signals. But despite the rules and regulations, people still continue driving recklessly.

My condolences to those who've passed away in the accident.

But on actual paved roads where other cars are driving, I just can't see it. Not that I haven't been in the back of a truck in my youth, cuz I was. But I remember too well that there is almost nothing you can do to hold on, when the truck hits a good bump in the road, or has to swerve to miss a deer or possum in the night.

I got very angry at my brother for taking my 10 year old daughter in the back of his Toyota pick-up, and he even went off-roading. Sure it seems like innocent fun at the time, but it just takes one stupid thing, and someone gets brain damage for life. Thank goodness it didn't happen to my daughter, but how many kids has it happened to? Or worse?

I cringe just to see dogs walking around in the beds of trucks when they are doing 40 or 50 mph.
  
Date: 7/19/2013 3:51:00 PM  From Authorid: 3835    It should be, that people (adults and children of at least an age to understand to keep still until vehicle stops) are allowed to ride in the back of a truck if under the conditions of those country roads, farming duties and chores, as long as the truck is driven responsibly like you said.. slow and cautiously, by someone legally allowed to drive.

That said, I do feel it is irresponsible of those that take it to the next level or two and drive on freeways and even in the cities itself sometimes, is really chaotic and uncertain changes are at every corner. Even if there is a camper style confinement attached to the truck and driven on freeways and busy cities, there is a high risk as well, if it isn't welded down to the truck and safety belts are not installed.. but why not just buy a van then, Lol.

I feel there should be dramatic fines enforced for those riding in the back of, and for those in charge of driving if this is off privately owned properties. The fine (or jail time) should be set extreme, so this would not become a repeat offender issue somewhere down the road..

What I mean is here in PA, it was quite legal when I was growing up, and doing so on a farm, I and my friends road in the back of my dad's pickup many times. But...NEVER on a highway or interstate. Dad would never have allowed that. Then later, the law came into effect. I'd always wondered what other states allowed this and which didn't. For my side of the debate, I have to say that laws are put in place as an umbrella effect, to cover all citizens and all situations. With that in mind, yes, there should be laws disallowing this. One can say that people should just use their heads, but that doesn't cover those who don't.
