You Don't Know What To Say???

Okay, as some of you know..2 weeks ago I fell in my icy driveway and sprained my ankle. Well, I lost 3 days of work and had no vacation nor personal time to take so lost almost $300 in pay. I called the landlord to let him know that I had fallen and we got no return phone call and the driveway STILL has not had anything done to it in the lines of salt, plowing, etc. Okay..so over the weekend my fiance's cousin comes to visit and almost as soon as he leaves, he calls us on his cell phone and tells us that some guy who lives in one of the apartments in this house is out there yelling at him and has grabbed his arm. So my fiance runs down and asks the guy if he has a problem and the guy says "Yeah, he's parked in front of my spot and I couldn't park". (Now, mind you..there are 3 open spots to park..) Jay tells the guy that Joe was here visiting and that he is leaving and the guy says "Yeah well I pay rent here.." and Jay says "So do we and we ARE allowed to have visitors, and at the time that he got here there was nowhere else to park". The guy keeps going on so long story short, we calm things down and Joe leaves but the guy is still running his mouth loudly next door. So, we call the landlord to let him know that we have a situation here and he's not home so Jay being upset that someone put their hands on one of our family isn't so nice on the message. That being said, Jay calms and we call the local cops and ask them to please come speak with our neighbor and explain to him that it is not necessary to lay his hands upon our visitors or yell, that at any time he could have knocked on our door and Joe (or any other visitor) would have simply moved their vehicle. So the cops agree with us and do so. FINALLY, the next day our landlord shows up and is quite snippy about Jay's message..and I told him that he would be upset if someone grabbed someone in his family who was visiting him as well. He agrees and says that we did the right thing by calling the cops and in fact if we have any ore problems to just call them because he would prefer not to get into the middle of any conflicts between his tenants..?????? Isn't that what a landlord is for?? Then I again tell him about falling and ask him if he can maintain the driveway a bit better to avoid any more falls by either myself or anyone in any of the other apartments etc...he tells me, "I don't know what to tell you..I can leave some salt and someone will have to sprinkle it when it's needed". I was ASTOUNDED..we pay him almost $500 a month to live here and he doesn't want to fix anything or do anything..isn't that a landlord's responsibility to maintain the properrty??? NOTHING in our lease states that we have to maintain the property.. I then told him that although we are never, EVER late with our rent (and we have lived here for the entire 3 years we have been together) that we will have to be this month because I lost almost $300 in pay from being off with my sprained ankle and he shows no concern for my ankle..simply says to get the rent to him ASAP though because it's tax time and he needs the income to pay his taxes..LOL..am I being unreasonable or is he just a negligent landlord???

Date: 1/12/2005 4:54:00 PM  From Authorid: 35808    What a jerk, I'd move "ASAP" and file some sort of suit sueing him for lost income and any other damages that resulted from his stupidness. Take pictures of your ankle, the drive way, and keep a record of conversations and msgs and use that as evidence, good luck.

Check in with your local city ordinances. most likely the responsibility for snow removal and prodving a safge walk way falls on the property owner, unless something is stated otherwise in your lease. Once you find out that information, turn him into the city for not following the ordinance.

I don't know if you'd have any legal recourse without a police report being filed about the injury, but at the very least you could take him to small claims court and try to get it back.

I have started looking in the papers for a new place to live and my fiance agrees..he says for what we pay here we could get a whole house somewhere and not have to deal with the types of people that he has been filling the other apartments with either.

I will have to check into this and find out because at this point I am really NOT impressed with his attitude. He gets his rent on time each month and we rarely call him for anything..and one of the rare times that we have an issue he acts like this..

I'm not sure what his responsibility is with regard to the ice on the walkway. It doesn't seem reasonable to me to think that whenever it snows, that the landlord will have to hussle over to shovel your driveway, pathway or whatever. You should look at your lease and or contact the city to see who is responsible for those issues.

Date: 1/12/2005 5:42:00 PM  ( From Author ) From Authorid: 62100    Wild Bob..I can see what you are saying about the dispute with the other tenant, but I still felt that we had a responsibility to let him know what was happening and that he would at least care a little bit..I mean, had this guy hurt Joe then the landlord would have HAD to get involved you know?? As far as the upkeep..it's not just the steps nor the walkway but the ENTIRE driveway which is actually quite long. Now, he mows the lawn in good weather and such but I have yet to see him ever take care of the ice and snow. I will have to check into it and see..but I know that our driveway doesn't fall under the town's responsibility for sure.  
Date: 1/12/2005 6:25:00 PM  From Authorid: 10245    he might not be held to ordinance for removing the snow then... I misunderstood initially and thought this was an apartment complex. He shows up to mow because that's usually a ticketable offense after the grass reaches more than 7 inches or something like that, and tall grass is much more visible than deep snow. Also check into rules and regulations that he must comply with with regarding renting his property.
