I am having a bit of legal issues here and I need input because I am coming up with a road block every where I turn simply because I don’t know where I am supposed to turn. My husband is currently in Prison he is in there for a parole violation we don’t deny that he violated his parole and now has to do the time. The violation was for moving in with me after we married and we didn’t take the right steps to have his parole transferred. The problem is we are now trying to get the transfer while he is in prison and his prison counselor is refusing to give him the form or file it so he asked for a 602 which I don’t know exactly how to word it but it is an appeal type thing to her decision, she has also refused to get that for him. I don’t know where to go for help. He should have had a public defender at his hearing and wasn’t given one, his parole officer that has no control until his release(from what he says) said that by her refusing she is denying him his right to due process. Before his arrest he had been on the run for 9 months. When I say on the run I mean in violation, his parole officer had my address, my phone number and everything else she needed to know about me. He had held the same job for over a year was supporting his family and staying clean. granted we were having some problems and I think his going away has saved our marriage, but that’s a whole other story. So can anybody out there help me give me some advice. I already wrote to dear old Arnold and many other politicians with no response. I have tried contacting the public defenders office myself to no avail. all the pro bono attorneys I can find wont help on a case like this and I cant afford an attorney. Also he has an N number right now and what that means is he is considered a civil addict we sent in an exclusion writ and that was also denied but it states it was denied because we didn’t follow the proper channels but it seems that nobody knows what the proper channels are.... HELP PLEASE

Date: 10/13/2004 11:06:00 PM  From Authorid: 20956    goodness i have no idea - perhaps speak to some one at the jail directly? Speak to a lawyer? i am not sure, wish you all the luck in the world though !!
Date: 10/13/2004 11:08:00 PM  From Authorid: 55408    The only thing I can think of is to save aside enough money to hire a lawyer. In the mean time, get advise from a lawyer, I don't know if it costs anything, but if you can afford it I'd try that now.

As far as not having a public defender at the court hearing means he was denied a right and that can be fought in court, you guys will just have to file a complaint in court. Good luck!
