Is this Child Endangerment?

Parents can make mistakes

Occasionally, the police will get carried away and do something that completely flies in the face of logic.

Such is the case of Darlene Hahnfeld.

On Aug. 15, Algonquin police charged Hahnfeld with child endangerment. Apparently on July 22, Hahnfeld had a fever and wasn't feeling well. She and her two youngest children, who are 2 and 4 years old, all took a nap.

The kids woke up first. Believing their mother was outside, they went in the back yard. After playing for a bit, the kids tried to go back inside and realized they were locked out. They pounded on the door and shouted, but Hahnfeld didn't hear them.

After about 45 minutes, a neighbor called police.

"I've never seen her children unattended," said the neighbor, who asked that her name not be used. "It was not normal. I honestly thought something had happened to her. I thought maybe she had fallen and hit her head."

There are no hard feelings between Hahnfeld and the neighbor, who are only acquaintances. Hahnfeld was so appreciative of the neighbor's concern that she sent her a gift basket and thank-you card.

Then, three weeks after the incident, Hahnfeld received a call from the Algonquin Police Department.

"They told me they were going to issue a warrant for my arrest," she said. "I've never been arrested for anything."

That's a bit excessive for someone who has no history of parental problems.

"You have to look at the potential outcome," Algonquin Deputy Police Chief Ed Urban said.

Which is true. Of course, the same can be said every time a kid wanders off in a store.

The fact is, Hahnfeld made a mistake. And may the first parent who hasn't fouled up cast the first stone.

Hahnfeld's error pales in comparison to what normally qualifies as "child endangerment."

On the same day Hahnfeld was charged, Algonquin police charged Kelly Flannigan with child endangerment. In that case, police allege that Flannigan tried to hit her husband with a phone and accidentally hit her kid in the head.

In July, Lake in the Hills police charged Rockford resident Sarah Frye with child endangerment. The reason? Police officers were chasing Frye because she was wanted on a warrant. After the chase, which began in Algonquin, police discovered a 20-month-old in the back seat.

I'm not sure either of those incidents are in the same ballpark as "I took a nap, and my kids went outside."

Surely Hahnfeld could have been more careful. But there's a big difference between making a mistake and being a neglectful parent.

-Sunni

Date: 8/24/2004 4:57:00 AM  ( From Author ) From Authorid: 62675    I mean she fell asleep!! This is crazy! I fall asleep all the time! And I sleep later then my son sometimes!! Should I be arrested?? Granted my son knows not to go outside, but her kids went to the back yard to look for her. If the door hadn't been locked, noone would have known anything. Just ridiculous!!
Date: 8/24/2004 5:05:00 AM  From Authorid: 36901    I totally agree with you. I don't think that is child endangerment at all. Especially when you consider that it was a one time thing.
Date: 8/24/2004 5:14:00 AM  ( From Author ) From Authorid: 62675    It makes me SOOOO MAD. That poor woman. And can you imagine the guilt the neighbor must be feeling? She just tried to do the right thing out of concern for her well being and it brings about a warrent for an arrest!
Date: 8/24/2004 5:41:00 AM  From Authorid: 15228    The woman was sick! I remember being very sick, throwing-up constantly when my daughter wasn't even two and my husband was away in the Gulf war---it is hard to throw-up and take care of a toddler at the same time, lucky for me my daughter didn't get outside. This is ridiculous.
Date: 8/24/2004 5:47:00 AM  From Authorid: 10245    It's amazing what they can deem neglect and endangerment. I'm still 1/2 expecting something to come from my sons little naptime jailbreak to the ice cream store. When he happened to show up, some cops were enjoying a banana split. They came to get me to bring him home, but so far... nothing except a report.
Date: 8/24/2004 5:49:00 AM  From Authorid: 19772    Yeah I agree being sick and taking a nap are hardly crimes. As a mother I know it has happened on more than one occasion to me. ~Gabrielle~
Date: 8/24/2004 5:52:00 AM  From Authorid: 53900    I guess you are darned if you do and darned if you dont. For instance if you go out to a shopping mall and you let your child run around then people whisper and talk about how unruly your child is but then hold their hand and have them whine about being allowed to walk by themselves and people talk about how mean you are for not letting your child walk free and god forbid you put a leash on your child. I personally have fallen asleep a few times when my kids were awake. They never got out of the house because they knew to stay in but trust me they made some monstrous messes inside. At one point in time I was on medications for kidney infections that would literally make me pass out and I had to take this medicine or else. I was hospitalized for these infections twice because I would not know they were there until they got really really bad but needless to say I am sure they would say that was child endangerment also. I think the problem is that we have allowed the state to much power to tell us how we should raise our kids and they are not trained properly and are overworked and underpaid. We need better training for them more people to work so each person has fewer caseloads and a way to document who it is who calls cases in so as to weed out people who are calling to report soemone for revenge and if it is found that people are calling simply for revenge they should be charged with a crime
Date: 8/24/2004 6:00:00 AM  From Authorid: 11341    I bet she feels bad enough knowing her kids were locked out of the house. I feel bad for the woman, she shouldnt be arrested for falling asleep. I am pretty sure that just about every parent out there has been asleep while their child is awake. Im am glad nothing bad happened to the kids though, crazy world we live in....
Date: 8/24/2004 6:01:00 AM  From Authorid: 160    When the government finally makes perfect choices, and become an ideal place of refuge for people, they need not look at people that are imperfect. People make mistakes and in this case the poor woman was sick with fever. But there is no more compassion or empathy left in society today. It's just the way that things are unfortunatly. And this is just a symptom of a sick society.
Date: 8/24/2004 6:20:00 AM  From Authorid: 59418    That's absolutely ridiculous! The poor woman just made a mistake!
Date: 8/24/2004 6:32:00 AM  From Authorid: 26363    If this is considered outright endangerment then 90% of parents would be in error in the eyes of the law. This has happened to me twice! The first when my first son was three and again 13 yrs later when me second son was three. Parenting can be very tiring and I for one have taken my share of naps. These incidences are unfortunate and the result can be very frightening for the parents and child(ren) involved but I for one can attest to the fact it left me feeling quite inadequate as a parent for a long time after. These things happen, they are not intentional and one cannot keep an eye on their child every single minute 24/7! I think the action of the police is way over the top in this case. What a shame.
Date: 8/24/2004 9:50:00 AM  From Authorid: 4144    that is one of the more ignorant things i have heard in a long time. what kind of idiot would arrest someone for that? yea, i see what COULD have happened but nothing happened. they should have listened to the neighbor a little closer. she had never seen the kids unattended before. sounds to me like somebody wanting to get his or her name in the paper or on tv. this one will probably end up in jail and the one in the car chase will probably get off.
Date: 8/24/2004 9:53:00 AM  From Authorid: 4144    THIS JUST IN....... while i was replying to your post i heard on the radio that these two women in my area were just sentenced for child neglect. i didn't catch how much time but what happened was this five year old girl was locked in a dog cage by her mother and grandmother for three days. i'm sure they won't serve much time.
Date: 8/24/2004 10:17:00 AM  ( From Author ) From Authorid: 62675    Moma Bug - Now that IS child neglect!!! SO sad. And you are right the horrible ones get small sentances while the ones who take a nap cause they are sick will be in huge trouble!!
Date: 8/24/2004 10:18:00 AM  From Authorid: 46527    So had the woman locked the door and the kids remained indoors she would hav been safe from the law...how ridiculous! All mothers get put inthis situation at least once in their lives and I don't know of any that would do any different to this poor woman!
Date: 8/24/2004 12:39:00 PM  From Authorid: 50434    They are going way over board on this one. Its not like she locked her kids outside or anything. If I were her I would sure them right back for defamation of character.
Date: 8/24/2004 2:07:00 PM  From Authorid: 62367    Another case of the death of common sense. The poor lady was ill. If I were in her condition I would have kept the doors locked too. I guess they will have to alter the locks so they can not get out when the locks are on which is a fire hazard. Parents are supposed to keep total control of their kids while keeping them at arms length.
Date: 8/24/2004 3:53:00 PM  From Authorid: 51070    It was just a silly mistake. Some people get too carried away.
Date: 8/24/2004 4:11:00 PM  From Authorid: 44321    I was locked out of the house once, all because of a neighbor dog trying to get in the house, so I shut the door not realising the lock was turned, imagine if the cop who helped me get back in had charged me with endangerment because a parent was not in the house for about 5-10 minutes being up at the post office calling for help ..good lord. She laid down for a nap,the only reason the kids went out is because they thought mommy was out there, unfortunately the door locked on them, luckily though they were safe.
Date: 8/24/2004 4:13:00 PM  From Authorid: 44321    She should go to a hardware shop and buy a hook and eye latch and install it way up on the door, though I doubt this lady will nap again when feeling sick, she will be too worried this could happen again.
Date: 8/24/2004 5:31:00 PM  From Authorid: 62753    LQQK at the world we live in !!! This is crazy! One time my little boy got up in the middle of the night, came into my husbands room and mine, and sat at the end of the bed, he had gotten into the fridge and grabbed a pudding.... he got chocolate all over our bedspread... he was about 2 .............. imagine if he walked outside... makes me sick to think about it! Lizard-1
Date: 8/24/2004 10:09:00 PM  From Authorid: 27046    Reminds me of a few years ago when on a Saturday morning about 6:45am my 2 and 4 year olds wandered off into the back yard to play and the neighbor called the cops for the same reason, subsequently thinking that something happened to us. The cops were complete jerks to me and treated me like I was some crackhead mother conked out asleep on my couch at 3pm in the afternoon while my kids were running around rampant. My doors WERE locked, but apparently without us knowing at the time, my daughter could unlock it. They never even took mine or the kids names, or filed a report, but the first thing I did was run around my house and clean every single thing in site, because I expected social services to drop by. They never did though.
