right of way laws

One evening last fall our horses got out. they went over to my parents place because that is where they used to live. my parents called me and my daughter and i went to go get the horses. my mom was in the car on the right side of the road kind of marking where we were (we were on the left hand sidesholdure) a couple of cars went around us just fine then we saw a car coming towards us it wasn't slowing down so my mom started flashing her headlights and they still did not slow down the car struck the horse in front of me and then seemed to speed up i tried to push the two horses i had down to the bottom of the ditch but we didn't get out of the way fast enough the car hit me and both horses dragging one of them and then continued on and hit my daughter she flew in the ditch and when the car finally stopped it threw dimond on to my daughter luckily my daughter and i didn't have any severe injuries but i am sad to say that dimond had ashattered hip and her leg was broken so she was put down humanely anyways the officer told us that we were in the cars right of way and were at fault and to ad insult to injury when he wrote out his report it said we were in the middle of the road i ask you if you saw a car coming would you be in the middle of the road? and when did the shoulder of the road and the ditch become a place for cars to drive?
