I'm kinda on both sides of this issue. There are those who really do need to be put into a mental hospital instead of a jail and then there are those that totally abuse that legal defense and some even get away with it. |

I think it's a bunch of bull. In most cases, you must have been insane to have committed a crime in the first place. I think too many lawyers and criminals use that excuse, when there really are mentally disable people in the world who get a bad reputation. |

There was this one judge who was threatened by some media once. They claimed that they had all sorts of stuff on him that could send him to jail, or even have him put on death row. But, being the Gooood Judge he is, he said that he'd plead insanity and get away with it. I forget whether he did it or not...but the point is that this could be used as a loop-hole for some criminals who don't want the hard life after getting caught. |

I am more against it, than for it. But then again, I feel very badly for the truly mentally ill. This is a very tough call. I remember reciently in Texas they had a person put to death, and when he had his last meal, it was so good he wanted to "Save half for breakfast". His IQ was 73. He honestly did not understand he was going to die. He was retarded. But he was put to death shortly after midnight that night. I am a strong supporter of the Death Penalty. But, that was too sad.Now imagine a poor schitzo, who sees things & hears voices....*sigh* |

Sanity=Jail Insanity=Institution. Its a catch 22 defence, although I suppose you can avoid the death penalty. In one case I think lawyers wanted to give an insane man drugs to make him sane, just so they could execute him... |
