Punishemnts for committing crimes...is it enough?

After seeing tonight on the news that the main suspect in the kidnapping of that little girl Carlie Brucia has been brought in for questioning (and he refuses to talk to police or answer any questions) and has been arrested over 13 times...once for kidnapping (although it was aquitted probably on some stupid technicality) and is now out of prison again it just makes me sick. I am so very tired of people committing crimes then going to jail for a few months or maybe years and then getting back out to do it all over again. Then while they are in prison/jail they get their meals provided to them, an education, a roof over their head all at the taxpayers expense. I dont mind paying for them to be locked up but they should get only the bare minimum of what they need. I can think of many many examples where the person was either let off or got out of jail only to do teh same thing all over again.

I heard on the news yesterday there is a man who was arrested for beating his five month old son. He is now in intensive care with two broken arms, two broken legs, internal bleeding just to name some of his injuries. Now I bet some lawyer will get this guy life or less when he really deserves the same thing he dealt out to his little baby.

Ooooohhhhh it just makes me so angry when I think about this kinda stuff. I think when you committ a crime you should do the entire sentence...no time off, no parole and make it really hard on you while you are there. OK I got that off my chest...What are your opinions on how the justice system works and on the prison system today?

Date: 2/5/2004 10:04:00 PM  From Authorid: 24319    I basically agree. One thing I want to touch on though, is that it's not as good as it sounds being in jail. I've known many people who have been in jail. Sure, they get some things, but look at it this way. They are TOLD when they can do these things. Some prisons have 23 hour lock down and you have 1 hour to do what you are allowed to do. Sure, prison can be harder on them, and maybe should be. But I doubt anyone in there are happy being there.
Date: 2/5/2004 10:07:00 PM  From Authorid: 51049    I know exactly what you mean, some things just don't seem fair. I sometimes wonder who comes up with this so called punishments?? Some of the punishments seem a little backwards to me.
Date: 2/5/2004 10:11:00 PM  ( From Author ) From Authorid: 53900    Carrie I kinda agree with you I also know some people who are in prison. One of them is in their for vehicular manslaughter...he got into an accident and hit a woman who ran a red light he got scared and elft the scene cause his license was suspended and he got a harder sentence for that. He got 12 years I believe....now he is getting to learn a skill for when he gets out. Is that fair? Should we have to pay for him to get a education of any type?
Date: 2/5/2004 10:11:00 PM  From Authorid: 36704    My cousin who's a juvenile defender recently had a 15 year old client who was offered a plea bargain of no jail time, just probation by the prosecutor which he obviously took and a few weeks later shot and killed someone. There was also a story in the news recently about a guy who a year ago killed his girlfriend's baby and confessed to it and was never brought up on charges. Last month he killed his new girlfriend's baby and the reason they said they never charged him the first time was because they thought he was lying to coverup for his girlfriend. So, it definitely has its problems.
Date: 2/5/2004 10:14:00 PM  From Authorid: 62422    i agree with you on this one 100%! cyndi.
Date: 2/5/2004 10:14:00 PM  ( From Author ) From Authorid: 53900    And if this guy turns out to be involved with the disappearance of that little girl should he have been out to begin with? He is on parole now and his parole officer petitioned the court to put him back in prison because he was not paying but that was denied....It just makes me angry sometimes. Another perfect example is Susan Smith...what she did to her children was beyond anything I have ever heard....absolutely horrible and she is being allowed to live her life granted it is a life behind bars but she is still lving while her two children were not given that opurtunity. If it was up to me I would have done teh same thing to her that she did to her kids
Date: 2/5/2004 10:17:00 PM  ( From Author ) From Authorid: 53900    Ohhhh Base that reminds me of this show I saw the otehr day this guy killed his pregnant girlfriend who was 9 months pregnant and he was only charged with one murder....then another guy killed the baby his wife/girlfriend was carrying(not really sure which) and I dont think he got any time in jail....I mean that just ticks me off so badly
Date: 2/5/2004 10:19:00 PM  From Authorid: 24319    I'm kinda torn on the issue. I shouldn't go into it right now since I am close to passing out from tiredness. lol, so I'll comment tomorrow

Date: 2/5/2004 10:30:00 PM  From Authorid: 36704    Yeah, since I have a lot of family who work in the justice system I've heard a lot of crazy stories. The court system and prison system are both messed up.
Date: 2/5/2004 10:39:00 PM  ( From Author ) From Authorid: 53900    Yes they most defenitely are
Date: 2/5/2004 10:41:00 PM  ( From Author ) From Authorid: 53900    Oh BTW that guy was engaged to my cousin/good friend (she was one of my good friends and is my husbands cousin so now she is both to me hehe) I feel bad for him in some ways because I dont really think he should have been charged and had he stayed at teh scene all he would have been charged with was driving on a suspended license because there were several witnesses who saw this woman run the red light
Date: 2/6/2004 7:59:00 AM  From Authorid: 36967    The reason for these technicallities is that before the Revolutionary war, the British had so much requirments, and torture on the American Settlers. That was really the reason for America going to fight the war for independence. I agree there was a time for this, like buring the Revolutionary War, but herei s a News Flash for the ACLU, CONGRESS, our PRESIDENT, SUPREME COURT, etc. WE ARE NOT UNDER BRITISH RULE ANYMORE. I am not saying throw away the consitution, that is not what I am saying. I think we definately need to change it.
Date: 2/6/2004 8:24:00 AM  From Authorid: 2030    Well considering the fact that the ACLU is currently defending (pro Bono) the American Man/Boy love association (disgusting pedophiles, it's pretty easy to see where they stand. We need to get past the "rehabilitation" mind set and understand the simple Crime = Punishment idea. make prison and/or the death penalty an effective deterent to crime. I could care less about criminals, they make their choices. I can sit here today and tell anyone that I will never go to prison. Why? Because I intend to obey the law, it's not that hard to do.
Date: 2/6/2004 8:46:00 AM  ( From Author ) From Authorid: 53900    Yes Drkptrs...I agree we need to do something to ensure that monsters like Joseph Smith do not get turned out to prey on our children...we need to do something to make sure that when we tell our kids to say no to drugs we make it harder for the drug dealers to sell drugs and when tehy are caught make them stay in prison longer with fewer chances once they are released. Lets stop wasting time with appeals so that those who are death row do not sit there for years and years. They get there for a reason. Lets start using the punishment for what it was designed for.
Date: 2/6/2004 8:48:00 AM  From Authorid: 38849    In answer to your question, if you start giving everybody the maximum penalty under the law, defense lawyers are going to argue its cruel and unusual punishment. Doesn't mean I disagree... but it would happen. I do agree, repeat offenders need to have longer sentences without parole. At what point in time should parole no longer be offered? Depends on the type of crime committed. Drug offences I think should be the shortest jail time, but in lieu of longer rehab time. Kidnapping, should be a longer sentence... parole should be based on the circumstances... kidnapping your own kid?

Just a couple thoughts. --

Date: 2/6/2004 8:49:00 AM  ( From Author ) From Authorid: 53900    BCAR I agree with you completely...following the laws is very simple. They were designed to protect us and we know right from wrong. That guy who took that little girl knew what he was doing. He let her parents live on false hope for five whole days. The death penalty in my opinion is too good for him. What I would like to do defenitely does not fit in teh guidelines of this site
Date: 2/6/2004 8:51:00 AM  ( From Author ) From Authorid: 53900    Zayden when we preach to our children that doing drugs is wrong then we take the offenders who are selling drugs and repeatedly give them probation or a few years in prison and turn them back out on the streets to committ the same acts that put them there to begin with what message does that send our kids? And why should we protect the rights of someone who is found guilty when teh rights of their victims have been completely stripped?
Date: 2/6/2004 9:03:00 AM  From Authorid: 38849    Hey, you found a good reason for circumstance defining the punishment.... Yeah... I would agree drug possesion with the intent to sell should have a steeper penalty.... --
Date: 2/6/2004 9:11:00 AM  From Authorid: 38849    You do ask some tough questions, and like I said, I don't fully agree with how punishment is defined for all crimes, but the problem that exists isn't that we have bad punishments... but how the punishments are applied. Circumstances around the committed crime need to define the punishments handed out. IN some cases, the punishments for some crimes need to be completely overhauled, but like I said, giving all criminals the maximum punishment for every crime isn't right either. And it has nothing to do with rights...

My drug offenses was dealing with users/abusers of drugs... not dealers... sorry. In so far as other crimes it depends on the crime. Take a psychiatrically insane person, they commit a crime, did the person know right from wrong? Probably not, BUT can the person EVER know right from wrong? Who knows? How should the punishment be handled for such a person?

If you are asking me from standpoint, while I am not family, where I am from one of my friends was brutally murdered in a quadruple murder, execution style. How did I feel when I found out the murders were released by mistake? Pretty mad actually. So I do see your point, some punishments need to better fit the crime. Others, need to remain the same. Mostly, circumstances need to define what the punishment should be. --
