I've known many people who have been in jail. Sure, they get some things, but look at it this way. They are TOLD when they can do these things. Some prisons have 23 hour lock down and you have 1 hour to do what you are allowed to do. Sure, prison can be harder on them, and maybe should be. But I doubt anyone in there are happy being there. |

One of them is in their for vehicular manslaughter...he got into an accident and hit a woman who ran a red light he got scared and elft the scene cause his license was suspended and he got a harder sentence for that. He got 12 years I believe....now he is getting to learn a skill for when he gets out. Is that fair? Should we have to pay for him to get a education of any type? |
Date: 2/5/2004 10:11:00 PM From Authorid: 36704 My cousin who's a juvenile defender recently had a 15 year old client who was offered a plea bargain of no jail time, just probation by the prosecutor which he obviously took and a few weeks later shot and killed someone. There was also a story in the news recently about a guy who a year ago killed his girlfriend's baby and confessed to it and was never brought up on charges. Last month he killed his new girlfriend's baby and the reason they said they never charged him the first time was because they thought he was lying to coverup for his girlfriend. So, it definitely has its problems. |

He is on parole now and his parole officer petitioned the court to put him back in prison because he was not paying but that was denied....It just makes me angry sometimes. Another perfect example is Susan Smith...what she did to her children was beyond anything I have ever heard....absolutely horrible and she is being allowed to live her life granted it is a life behind bars but she is still lving while her two children were not given that opurtunity. If it was up to me I would have done teh same thing to her that she did to her kids |
Date: 2/5/2004 10:17:00 PM ( From Author ) From Authorid: 53900 Ohhhh Base that reminds me of this show I saw the otehr day this guy killed his pregnant girlfriend who was 9 months pregnant and he was only charged with one murder....then another guy killed the baby his wife/girlfriend was carrying(not really sure which) and I dont think he got any time in jail....I mean that just ticks me off so badly |

That was really the reason for America going to fight the war for independence. We need to get past the "rehabilitation" mind set and understand the simple Crime = Punishment idea. make prison and/or the death penalty an effective deterent to crime. I could care less about criminals, they make their choices. I can sit here today and tell anyone that I will never go to prison. Why? Because I intend to obey the law, it's not that hard to do. |
Date: 2/6/2004 8:46:00 AM ( From Author ) From Authorid: 53900 Yes Drkptrs...I agree we need to do something to ensure that monsters like Joseph Smith do not get turned out to prey on our children...we need to do something to make sure that when we tell our kids to say no to drugs we make it harder for the drug dealers to sell drugs and when tehy are caught make them stay in prison longer with fewer chances once they are released. Lets stop wasting time with appeals so that those who are death row do not sit there for years and years. They get there for a reason. Lets start using the punishment for what it was designed for. |

In answer to your question, if you start giving everybody the maximum penalty under the law, defense lawyers are going to argue its cruel and unusual punishment. Doesn't mean I disagree... but it would happen. I do agree, repeat offenders need to have longer sentences without parole. At what point in time should parole no longer be offered? Depends on the type of crime committed. Drug offences I think should be the shortest jail time, but in lieu of longer rehab time. Kidnapping, should be a longer sentence... parole should be based on the circumstances... kidnapping your own kid? Just a couple thoughts. -- |

That guy who took that little girl knew what he was doing. He let her parents live on false hope for five whole days. The death penalty in my opinion is too good for him. And why should we protect the rights of someone who is found guilty when teh rights of their victims have been completely stripped? |

You do ask some tough questions, and like I said, I don't fully agree with how punishment is defined for all crimes, but the problem that exists isn't that we have bad punishments... but how the punishments are applied. Circumstances around the committed crime need to define the punishments handed out. IN some cases, the punishments for some crimes need to be completely overhauled, but like I said, giving all criminals the maximum punishment for every crime isn't right either. And it has nothing to do with rights... My drug offenses was dealing with users/abusers of drugs... not dealers... sorry. In so far as other crimes it depends on the crime. Take a psychiatrically insane person, they commit a crime, did the person know right from wrong? Probably not, BUT can the person EVER know right from wrong? Who knows? How should the punishment be handled for such a person? If you are asking me from standpoint, while I am not family, where I am from one of my friends was brutally murdered in a quadruple murder, execution style. How did I feel when I found out the murders were released by mistake? Pretty mad actually. So I do see your point, some punishments need to better fit the crime. Others, need to remain the same. Mostly, circumstances need to define what the punishment should be. -- |
