Ask him if he transfered money to the payroll account because you can't cash your check. That isn't right at all...obviously your company must have money issues if he holds them. If thats the case maybe he should lay off some people. |

Yeah Ip he really is having money problems right now....the only thing is im the payroll account he writes me personal checks..so i guess the money should be comming from his personal account..but he must have already spent it all..8( |

Wow that is ridiculous really. And sad to say, but the only option would be to find another job or just not let it upset you so much. Maybe you should mention laying off employees to him and also throw in that you would be willing to help pick up the slack...I would think you could call the Better Business Bureau, but your name will show up on the complaint, or they might could direct you on where to go besided them. |

The place you would need to call is your local Wage and Labor Board but I dont know how much they could do and you also need to talk to a accountant when tax time rolls around especially if you do not get a W2 |

Maybe it's time to find a better place to work. I worked for one guy who always had cash flow problems. Paychecks were routinely late etc. Finally I got a different job. It's so nice to get your check on time. |

Probably wouldn't get you in hot with the IRS, but you never know. You should be reporting him because you yourself said that you aren't paying taxes. If you get caught YOU will be in big trouble because of it. Report him anonymously if you want to but start socking away some funds for your taxes. |

I also work in a place where sometimes we don't get paid when we should but the situation with my boss is totally understandable. I work for a banquet house and we do weddings and stuff. We make $3.30 an hour, punch a clock and get a computer printed check on time everyweek. At the end of the week I also get a cash envelope which includes my gratuity or tips that I made for the parties that I worked. When you pay for an event such as a wedding reception or party you pay most times about an 18% gratuity and that money is paid to pay the help that served your food, decorated and cleaned up your mess. So for a reception, let's say it's one for about $20,000. He gets a deposit which is nowhere near the $20,000 and the rest is due the day of the event. Most people pay with a check or a credit card which means he is putting all his money out there for the food and supplies BEFORE he gets paid for it. On the rare occassion he doesn't have the cash for the envelope. I have been there for now for almost 8 months and my envelope had a balance on it twice and I get paid weekly. Sometimes it happens and we understand, but constantly not being able to pay your help is a big problem! |

Well I hate to say this but, I think you could get into a lot of trouble as well. Knowing that you don't pay taxes and you aren't unter his insureince is a big deal. I know I got bit by a dog at one of my jobs a few years ago. I saw a loyer about it, he wouldn't take the case becouse I was in a simular situation. He said he wouldn't defend me becouse I was guity as well. And if I brought it up to the corts I would get a hefty fine as well. Wether this is true, I can only assume. I would suggest eather quiting or demainding to be put on the pay roll. And yes after you have so many people on the pay roll (not sure how many) your insurance takes a BIG jump. Sorry to hear that this has happend to you...I would get out before something bad happens. Ignorence is no excuse for breaking the law (in the courts eyes). ......take care...deathletgo |

Thanks for the advice everyone..yeah wild bob that would be pretty nice lol ill probably be looking for a new job soon because i cant handle this..Thanks kronk and Azariryia..i thought maybe he would eventually start taxing me but its been months and he still hasnt done it...im not the only one who doesnt get taxed..most of the other people who work there dont get taxed either..i dont know why noone else has said anything to him.. thanks again everyone |

I neglected to mention that you are in DEEP if you get hurt like someone else said. If something were to fall over and hit you causing an injury none of your expenses are going to be covered and you can forget about workman's comp. Some of the most stupid things you wouldn't think of could be the things that hurt you. I worked in a grocery store for 7 years and worked with everything in it including the meat saws and the deli slicers. Never got hurt. Two weeks before they went out of business we were packing the store up and shelving fell down on my leg. They paid the medical expenses for the x-ray and the emergency room visit that I made. Something like that is going to come right out of your pocket without being properly classified as an employee in his books. |

Depending upon what you made for the whole year and you can figure out what you made cause I am going to assume that this guy isn't handing you a w-2 in the near future, by just estimating what you have made per week since you started. I think the amount used to be somewhere around $6000. Or in other words you have to make about $6000 for the year before you have to file that with the IRS. Because you started mid year you may have not reached their limit (which would highly be in your best interest to find out what the exact amount is) and may not have to file what you made. NOW you are going into a full work year which will most likely put you over the top for the amount you can make before having to file with the IRS. They can and will come after you for tax evasion. Years ago when my cousin was still under the working age she babysat for me so I could go to work and I claimed her for my daycare expenses on my tax returns. They only allow you to claim like $2500 in child care expenses which put her income from babysitting under the requirement to file a return herself. But you really need to look into protecting yourself. |

You may love working there but this guy needs to be set straight cause I guarentee you won't love him when he walks in tomorrow and tells you that he has to let you go and you can't get unemployment from him OR you mess your body up for the rest of your life with an accident and can't file a claim to get what is rightfully yours. |

I do bookkeeping for a living and technically what he is doing is "paying you under the table" along with the others that are getting a personal check. He is only accounting for a few people that he has on his books so that way he can skimp on taxes which eventually will catch up to him if he gets audited and if he's having money problems now he will probably end up claiming bankruptcy which means you will end up without a job anyway. NOW on your end...getting paid under the table is great and all when you are young because you get more money in your pocket because taxes aren't being taken out...BUT as you get older you need to file taxes and pay taxes and put in for your social security for when you get older...unless you marry someone rich and you don't have to worry about that...lol...My husband used to work for a company that never took taxes out and they paid their employees with 1099's at the end of the year which are used for subcontractors etc. When we got together he never filed his taxes for a year or two so that year I had him file his taxes. I told him basically his company screwed him by giving him 1099's all those years because now he had to pay all the taxes back. The company could have gotten in trouble for that as well. Needless to say after filing taxes for a few years he owed almost 4,000 in taxes. Don't get caught up in that..talk to your boss, if he don't correct the problem..then take a walk and find a new job. |

Oh yea one more thing I wanted to add my sister's ex husband used to have the same problem he drove a tow truck for a living and the company he worked for wrote several bad checks to him well he went to cash teh checks at a grovcery store that cashes payroll checks and when the checks bounced they not only went after the company who wrote the checks but after him also to get their money back. I did not think it was right or fair for that to happen but I guess it did. Like many people have told you leaving this place would be the best thing you can do...and when you do contact not only the wage and labor board but the IRS also |

i think you need to talk to him, tell your manager that he should not write a check that is to be cashed by employees if he cannot afford to pay them... also start looking for a new job.. sounds like there are some serious accounting issues... it sounds like there is something shady going on... i would call up the better business breau and file a report... and maybe give the IRS a call and ask about this... i'm sure there is something you can do... and keep going to th ebank and trying to cash those checks every time you do he is charged a fee for it "bouncing" if he really wanted people to get paid ontime he should have an "overdraft".. get out of this working situation! |
