with kobe's issue is they want to use her medical records to prove it was not rape, i think the DMV has a right to know anything that might impair your driving ability.. i don't think medical histories should be availible to the public but they should be availible to immediate family, and things that involve medical issues(aka insurances, DMV-they do have a right to know if you have tremors or blackouts) it's unfortunate that it gets used to do horrid things or petty reasons  |

I question the things I do sometimes. When I worked at Publix I decided to tell the manager when I got the job, and it so got thrown in my face. I don't graduate college until 05/05/05 (I think that date will bring me luck), but when it's 'real' time for me, I think it will also be 'witholding a specific truth time' too. I think if I get fired if I'm found out I can sue? I guess I'll cross the bridge when I get to it.  |

I don't think the DMV should know my medical history based on what MIGHT happen. I believe that people who suffer from Epilepsy have it noted on their driver's license. But, aside from that information, your medical history should be totally private. I think most people who suffer from something that could endanger themselves, or others, on the road, are pretty up front about it.  |

BMonkey, that is a very difficult question. People are SO stupid when it comes to disablilities. Frankly-I find people's attitudes are the real disabilities. When you graduate from school, hopefully your MS won't be an issue. We can always hope.....  |

TC-you are funny! But you know, there really are people who can take that type of information & use it against you. For example, say you are asked to tesify in a court case. Your anxiety & depression could be used to imply that your could be a less-than-credible witness. So, I think the Lawyers (except maybe your own) and the Judge do NOT need to know.  |

I am working on getting a 10 percent disability from the DAV, since my stress fracture came about during my time in the US Army, and is definately service connected. I hear that a ten percent only brings about 90 some dollars a month in disability pay, but at least it's something.  |

TC-we can thank the changes made in the Military benefits in, what?, 1979 or something? I mean originally one of the biggest draws for joining the military (aside from the collage tuition) was the medical benefits. Not now-I understand some Vets cannot even get benefits now.  |

Yes, I filed for SSI a couple of years ago but was turned down: Wasn't crazy enough, or lame enough. They were the ones that advised me to get with the DAV...and if that failed, then file with SSI again or SSD.  |

I know.......I learned the hard way. My Mom & I were diagnosed with cancer at the same time. In my Mom's case, there was a malpractice lawsuit since she had been misdiagnoised & mistreated for 3 years. By the time her cancer was discovered, she was a stage 4. During my recovery, I was treated for depression, and post-tramatic stress disorder. When it came time for me to give testamony before the hearing (pre-trial stuff). the Doctor's Lawyer somehow got access to my medical records, and tried to discredit me from testifying.  |

BTW=my Dad settled out of court. He was never in it for the money anyway. He was afraid of what the other Lawyer might try to do to me in cross-examination. He was afraid if I got emotional, the other Lawyer would try to dis-credit me using my Depression.  |

How many times did it take you until you got it? So far I've been denied twice. The tihng about me is that I have to take a medicine because it progresses if I don't take the said medicine. The last denial they gave me was on October 9th and I had 60 days and that has probably lapsed. Should I reapply, or I'm just wasting my time?  |

re-apply. Eventually they will have to give you a hearing in front of a Judge. That is your best bet. Even if the Judge decideds to deny you, you can STILL request an appeal. It took me 4 years. 2 denials, 1 hearing, and Sen. Bob Graham (Homeland Security-<D> Florida) PERSONALLY getting involved from his office in Washington DC before my benefits started.  |

BMonkey-when I didn't have health insurance, I had to use all differnt kinds of agencies to help me get the daily Meds I require. Not just Psych meds, but the synthroid, and pain meds I needed just to function.  |

I do not think that anybody such as employers or lawyers or anything should have access to your medical records or use your medical records against you unless you are a harm to yourself or others while employed for them or testifying for them or whatever the case may be. Its private information otherwise is what I think.  |

There are times when certain interests have a need to know concerning medical history. Many people do lie to a potential employer about a possible or past health problem. If a person becomes employeed, and then that problem crops up without the new employer knowing it was pre-existing, the new employer is then unfairly responsible for the medical needs of that person. Case in point; I had two back injuries before leaving the Navy in 1987. Almost every job appliation I filled out had a medical history section, that included "back injuries". I was honest, and answered that mine had been injured. I was turned down on several jobs because of it, but eventually was hired by a company that hired numerous veteran's, regardless of medical problems. This company knew if a problem cropped up, they were not responsible, but the military or VA would be. Now, if I had lied about my inury, and suddenly had a problem that required surgery or meany my being laid up, then whoever hired me would have ended up paying for that surgery or my workman's compensation while out of work. If it was learned that the injury was pre-existing, then I would have been out of a job for lieing on the appication, and when it comes to back injuries, pre-existing conditions do often show up. Insurance companies have a high enough liability every time they take someone on, which is one some now require physicals before coverage is given. Now, another case in point; a person works for 30+ years in one job or another, and for whatever reason, probably because they never felt it important, they have no life insurance. Suddenly, they find out they have terminal cancer, and have a year left to live. They then decide they need life insurance. If they tell the truth, they will be refused. If they lie, and no physical is required, then a year later their beneficiary is reaping the benefits of that lie, at the expense of everyone else that is insured. There are times when medical history needs to be known. There are a lot jobs today that require a security clearanceor background check. Medical, and in particular psycholigical history, could have a bearing on whether or not a person passes such checks. I am sure it would be great to find out the pilot of your plane is epilectic when you are flying at 30,000 feet. What about if the security guard at some place you have to frequent has fits of paranoi, and suddenly flashes back to some bad episode in his life where he had to shoot someone. Could be a bad scene. How about if the dirver of the 18 wheeler hauling hazardous material is prone to blackouts. I would sure hate to be on the same stretch of road he is on. Maybe the worker at the local day care is manic depressive with suicidal tendacies. I am sure it would be great for a group of young tots to watch teacher hang herself. While some of these examples may be the extreme, the fact is, that medical history does play an improtant role in today's society, and there are times when it needs to be known. Everything about a person's midical past may not be pertinent, but a lot of things are.  |

I definatly agree 100% with that. No one should have access to your medical history without your consent or if it is needed for actual purpose. Employers shouldn't need to know, nor should someone at an agency that consists of car insurance..etc. If this stays in effect, pretty soon there will be no privacy for anyone.  |

When it comes to medical problems which include depression and other things similar tot hat i think that no one needs to know at all...its the own persons personal information. i also eblieve that family should not be able to get records of medical things, i cant even get notes which were made on me i dont think but i wouldlove to see what they say LOLZ....sometimes you dont even know what they are wrotting about you yet a person could look up those records and find out info which was said about you and sue! ou would have no idea...NO ONE and i mean NO ONE should have access or even try to access medical records AT ALL!!!!!!  |

Unless it can affect your ability in work, or for medical reasons, I dont think anyone should be allowed access to medical records. I get bad migraines (luckily i dont drive yet) but I have medication for that so they have little affect. And a person's past should be left in the past.  |
