Hey everyone, I am back again, with yet another update on my brother...but it's bad this time. :-(
On Thursday we went to court with the lady who assulted him. (if you don't know what I mean, you can look back on my other posts) and we were for sure we were going to win but we went over our time, so we went back yesterday and they awarded this lady the win. We are sooo shocked!! ALL her evidance was false and our attorny made it perfectly clear on the first day that she took the law into her own hands and that she could have picked up the bike and gone home, but insted she approached my brother and grabbed him by the shrit. So he slid outta his shirt and ran. In the process of slidding out of his shirt his arms flew and she said "after he slid out of his shirt he pushed me to the ground." Which he did not, cause that was not in the police report. So anyways, she won the case, dont ask me why, it was very clear the first day that she was not going to win, but she did. So we are going to "appeal" the case and take her back to court, but until then Tommy has to sit in Juvi. :-( We were almost positive he was coming home. We had this case, it seemed like the judge just gave the case to the first person off the top of her head. She didn't even ask for a recess to think about it. When the attorny's said nothing further your honor, within a split second she made her decission. Like she didn't care who won, just so she could get outta the room. So....we are taking her back to court on Dec 2.
The bad news is that tommy won't be home for our trip to Las Vegas for Thanksgiving, his 16'th Birthday and my moms birthday. We are praying to god everyday that he'll be home on Dec 2. My mom taked to his Probation Officer too about letting me go see him cause I haven't seen him besides in court n over a month. And my PO said "No, she has to understand this is part of his detention." I know it is, but he has to understand that this is my brother thats in there, I havent seen him in over a month and taking someone who means so much to me away for a month is heart breaking. I cry a couple times a week cause I can't wait to see him. I know this is his detention, but by saying no, you can't see him is not right. He has no idea how close tommy and I are. Then he goes n says no, she can't see him till he comes home.
I'll keep you all updated on what happends next.
