Student Arrested For Good Deed

Teenager In Trouble In Inhaler Incident

(NBC)A teenager was disciplined for sharing medication used to treat asthma, but he said it saved his girlfriend's life, News2Houston reported Wednesday.

Andra Ferguson and her boyfriend, Brandon Kivi, both 15, use the same type of asthma medicine, Albuterol Inhalation Aerosol.

Ferguson said she forgot to bring her medication to their school, Caney Creek High School, on Sept. 24. When she had trouble breathing, she went to the nurse's office.

Out of concern, Kivi let her use his inhaler.

"I was trying to save her life. I didn't want her to die on me right there because the nurse's office (doesn't) have breathing machines," Kivi said.

"It made a big difference. It did save my life. It was a Good Samaritan act," Ferguson said.

But the school nurse said it was a violation of the district's no-tolerance drug policy, and reported Kivi to the campus police.

The next day, he was arrested and accused of delivering a dangerous drug. Kivi was also suspended from school for three days. He could face expulsion and sent to juvenile detention on juvenile drug charges.

The mothers of both teenagers are angry.

"My son will not go to jail. This is ridiculous," said Theresa Hock, Kivi's mother. "I believe he shouldn't be punished at all because he was helping her. She was in distress."

"If he hadn't helped her, she would have passed out or died or something because her asthma's been really bad this year," said Sandra Ferguson, Andra's mother.

The school principal said he couldn't do anything about it since Kivi not only broke school rules, but also allegedly violated state law.

"It's simply a matter that it's classified as a dangerous drug. It's an inhaler form, but yet, if it had been in pill form or any other, it's still classified as a dangerous drug," said Greg Poole, the Caney Creek principal.

"Would Caney Creek had want Andra to have died rather than my son to help her?" Hock said.

Poole said the nurse never considered Andra to be in a life-threatening situation.

The school district will hold a hearing on the matter Friday

Date: 10/11/2003 11:48:00 AM  From Authorid: 16164    hey you think if I send my kid to school she will get expelled?that is rediculous.astma at first may not seem so serious, but it can take a person down quick and they may seem just fine...if a person is diabetic and they "appear"ok.does it mean they are, no.these school districts take some things too far....a friend of mine got suspended for putting a sewing needle thru his pencil eraser in sewing class...because it was considered a dealy weapon, and than he was taken to juvinille for it...how many times has a person done that out of bordom in sewing class?ya think if I left the sewing needle in the oven mits I made, they could arrest me for a dealy weapon, and send me to jail for making a bomb if the pilot light on a gas stove blows out by accident, ya know sewing needles and gas ovens are a deadly combo I saw it on a movie once, gas ovens are baaaaaaad,hehe.

That's so stupid as well! I think that I remember hearing that some kids got suspended or something because a student gave another student some cough medican. Like those Hall candys.

Why? Because he had a deadly weapon. In 3rd grade. pulllease. Peace

In gym and when I tried out for volleyball, but of course didn't make it, both my teacher and the coach heard me wheezing because I get exercise-induced asthma, but isn't bad enough for medicine. Well, you always have to run over a dozen laps each day, in both gym and the stupid volleyball try-outs, so when I was running, I was wheezing and each on of them heard me and said..keep on running..you can do it..just breathe in and out..one way through your nose and the other through your mouth..don't stop otherwise you can leave..well I ran it and OMG..I thought I was going to die..I wheezed for like 15 minutes afterwards..It was no fun! Couldn't tell anyone because no one was around. Talk about unfair! What would happen if I did have an emergency attack, they would let me die or what?
Talk about school rules that suck!

She was charged with stupid crap as well the "controled substance" gig, although I don't see how something that can be bought over the counter would fall into that category. Zero tolerance should pertain to street/illegal drugs, only, not legit meds.

When school officials display such lack of common sense and decide to make such mountains out of mole hills for the sake of rules then something should be done about it. All incidents like this should be looked at on a case by case basis, rules are good but sometimes there are needs for exceptions, i think this is one of those cases.

Asthma attacks can become severe in a matter of minutes and it takes about 15 minutes for the medicine to work. By the time the nurse decided it might be a serious attack, it might be too late for the medicine to even have time to work. The boy did the right thing, the school did not.

Can't they think?-Would they rather her die, than have her bf do what he did? This reminds me of a guy who was shot here in Chicago....He must have been not too far from Ravenswood Hospital because he staggered himself there, but only got as far as the front of the hospital. The doctors were notified, but refused to treat him because of some policy (I'm not sure, but something about them not supposed to treat people unless they voluntary went INSIDE for treatment or they or someone else called the ambulance to pick them). The result of their bad judgement (not to mention callousness and thoughtlessness) resulted in the young man's death. I'm also not absolutely sure, but I think his death resulted in the changing of that policy. Is that what it takes for people to use their brains sometimes, the death of someone?!?!
