RIAA Sues 12 year old Girl

The RIAA has nailed one of the most prolific file-traders in the U.S., filing a lawsuit against 12-year-old Brianna LaHara.

When not at the playground with her friends, "Biggie Brianna" is trading music files from her home in New York. The little girl received one of the 261 lawsuits filed by the RIAA (Recording Industry Association of America) on Monday, according to the New York Post. She may look like a sweet and innocent child, but the RIAA says it's only going after major copyright violators at the moment. So you make the call.

"I got really scared. My stomach is all turning," Brianna told the Post. "I thought it was OK to download music because my mom paid a service fee for it. Out of all people, why did they pick me?"

It turns out that Brianna's mum paid a $29.99 service charge to KaZaA for the company's music service. Brianna, however, thought this meant she could download songs at will. How naive!

When reporters charged into Brianna's home, she was helping her brother with some homework. She is an honors student at St. Gregory the Great school.

Brianna could face charges of up to $150,000 per infringed song, but we have a feeling this might be a tad unrealistic. We suggest the RIAA take all of her toys instead.

"Nobody likes playing the heavy and having to resort to litigation," RIAA president Cary Sherman said in a statement. "But when your product is being regularly stolen, there comes a time when you have to take appropriate action."

Go get her, Cary. ®

Date: 9/11/2003 11:49:00 AM  From Authorid: 3688    her mother ended up paying $2000, totally sickening if you ask me
Date: 9/11/2003 11:50:00 AM  From Authorid: 51463    omg, it's very crazy to do that to a 12 year old and for what downloading music? I hate to break it to the world but people have been pirating things long before this and probably will for a long time. Record companies charge unfair prices for an album. I spent 25 bucks on Just Whitney Just For The Fans and it was a half hours worth of music (one of which was a remake of an old song) and a cheesy DVD with one music video and one compilation which was pretty bad itself. If I like a song I buy the album but I'm not gonna waist twenty bucks to buy someone's album because I like one song and don't want to put 'em out of business. Put out a quality product and people will buy. =-bootz-=
Date: 9/11/2003 12:14:00 PM  From Authorid: 25756    I agree with Bootz and that fine is WAAY overboard. This is so stupid!
Date: 9/11/2003 12:45:00 PM  From Authorid: 18527    Kazaa "Professional" is 29.99, that is why they did it, they thought if you paid, it was legal. Which makes PERFECT SENSE... sigh... I hope they all burn...
Date: 9/11/2003 12:57:00 PM  From Authorid: 56297    omg these ppl are so gready I meen she is a twelve year old for god sake she didnt even know it wasnt ok!!!!!! People are not going to stop just because of this new law! And plus wen u could download if you only wanted 1 song u didnt have to download a whole cd and now u have to buy a whole cd when all you want is one song and cds are like 15 bucks!!!!!!!!!!! Get a life people!
Date: 9/11/2003 1:04:00 PM  From Authorid: 33286    lol, that will teach her I bet you know, I lean more towards the artists and producers on this than I do the people stealing the music. like in my case, it is one thing for me to post my work on here for you all to read but if someone else did it you can bet that I would sue them for copywrite infringement. my work is not for anyone else to decide what to do with it, it is MINE...yes, pirating has gone on for years, does that mean there should be no attempt to stop it? I mean slavery went on for years too...and one last point, way back when cassete tapes first started to come out there was an uproar from the artists because it was known that the main reason to buy a blank tape was to record music, so now a portion of the money from every blank tape sold goes to recording artists. that can't exactly be done with a cd because you can record more than just music with them... every time a song gets played on the radio the artist gets paid, shouldn't the same hold true on the internet?
Date: 9/11/2003 2:06:00 PM  From Authorid: 60685    Come on! This is unreal. If they wanna sue someone it should be Kazaa. I find the whole thing plain silly.
Date: 9/11/2003 2:10:00 PM  From Authorid: 60685    I'd like to add, it sure doesn't seem like artists are starving, the ones with the hits own enought jewelry to feed a third world country so I don't know what all their sulking is about.
Date: 9/11/2003 2:47:00 PM  From Authorid: 23886    LoL! .. Omg! haha! ...hmm... uhh... Yeah! *No comment!*
Date: 9/11/2003 5:10:00 PM  From Authorid: 54968    I wonder why they're not sueing (sp?) Kazza...
Date: 9/11/2003 6:12:00 PM  From Authorid: 16164    geez if I were her mother, Id turn right around and sue kazaa....I remember when they were all having problems with napster for their downloads, now ya can pay a one dollar fee and download, I didnt hear anyone going all nuts about that.....so to all them people who have been downloading get ready to file major civil suits against those companies, how does a 12 year old know about copywrite infingments, and if the music industry had been forward to begin with as far as what their intentions were with music downloads from the beginning they wouldnt be out there suing everyone they can think of.it is their own fault anyway, charging between 15 to 14 dollars for a cd that costs about 25 cents to make, it costs about3-4 dollars to make a cassette tape, and they charge out the rear for cd's....than there is products other then that plus concert tickets and what not...they are crazy...but the only thing people can do is file against the companies they paid for the download services..they misled and THEY stole..theft by deciet or something like that....not the people......ya know what I mean.
Date: 9/11/2003 7:45:00 PM  From Authorid: 54987    I think its terrible that the music industry condones this. I have always bought cd of what I downloaded. But now I won't. I will boycott buying cds. I will buy used from now on. Will they also make it illegal to give someone a used cd? Oh well the music industry has lost out. Suing a 12 year old girl is a terrible indictment of our materialistic age.
Date: 9/12/2003 8:02:00 AM  ( Admin-FA )   I hate this whole not being able to download music crap.. I think it's all stupid and the RIAA is complete morons.. I think that the RIAA needs a reality check....
