Ok, first of all, laws over here in Puerto Rico are kinda different but this is what I undertsand about the situation. I was in a car crash and it happened like this... As I was driving the traffic suddeenly stopped due to a cargo truck pulling out of a warehouse and it had just rained moments ago. Thank God I was keeping my distance and wasn't going fast cause I wouldn't be here right now but fact of the matter is that I tried to stop my car and it slid out of control crashing the car in front. As explained by the police officer we could agree that I was responsible and simply settle at the insurance offices which we did. As the paperwork was finished I was told by the officer at the insurance that I could go and that would be it since the insurance would pay for the other car's damage which was basically a fender bender compared to my car which is yet to be fixed for I don't have any money. Afterwards, the lady whose car I crashed into starts harrassing me over the phone cuase she says the insurance didn't pay her enough money, that I owe her $250. As I understand, due to the fact that I took responsiblity and didn't have to argue in court about whose fault it was she has no right to take me to court to ask for those $250. Even further, my mom's best friend had a car crashed into hers two weeks ago and at the insurance the damaged was estimated at $1400 but the auto shop guy was asking her $2000 and when she went to the insurance stating this they clearly told her that she COULD NOT ASK the girl who crashed the car for the difference, that she was given what was fair and that auto shop people always inflate the price. Now this woman is saying she will even take me to court! I mean, my mom's friend is a smart lady so she went to the auto shop and said "this is what the insurance gives me, take it or leave it" and they fixed her car and left it like new. What's more, she thinks I'm stupid and that I'm gonna give her the money just like that, if I were to give her any money it would be in front of the insurance officials. Sigh, anyway, what do you guys think, if I had been drunk or speeding I would have said OK and payed in installments or something but I don't think it was directly my fault, I don't even have tickets on my record. Now, are there any lawyers out there, from what I understand, if she signed and accepted the insurance money knowing it was below the estimate she was given at the body shop she has no right to be asking any money.
