I think it all depends on the situation. I have been in situations with my own children on several different occassions. Sometimes the finances to prepare things the right way to prevent an accident are just not there in order to do so. It just goes to show you that even around a dozen or so people kids escape the watchful eye. Not long ago after my son was hit another relative of ours almost had their child hit during a party. There were at least 40 people in the backyard of this house and the child still managed to escape everyone's attention and leave the yard. Each circumstance is going to determine a different outcome and degree of liability.  |

I have to say that even if I had an alarm on the door of my house, I would most likely disengage it if I was having a party. You would think that if people will be coming in and out it's going to start driving you nuts. I mean I know that I would go crazy if I worked in one of those stores where the stupid door dings every time someone comes in or out of it....LOL  |

Yea I guess and I am sure that those parents feel totally awful...I dont know though one of those alarms you can get at a Walmart and they are only a few dollars even if they had put a slide lock that was to high for the litle boy to open the door it may have helped the situation. The thing is in Florida when a new pool is installed it is teh law to have a gate around the pool. I think there should be stricter guidelines for older pools also. I dont know about New York but here about one in every three or four homes has a pool that is alot of pools and that is not even counting the river, lakes, ponds and of course the ocean.  |

Okay but if your seriously sit back and think about it and I only say this because I know how parties go in my family. Just on my fathers side alone he has 3 brothers and sisters, all married with 3 kids, making 12 grandchildren, there are now currently more than half of us married with children of our own totalling 12 great grandchildren. We all get together for Christmas, Easter, Thanksgiving, graduations, weddings, etc. There is no way with a house full of 60 people that you are going to be able to slide the top lock on the door or even be in the frame of mind to say "Hey I am having 60 people over today, I better lock the top lock so Joey can't sneak past all 60 of us and run out into the road to get hit by a car." There are just some things in life that happen, sure sometimes the most stupid things happen that could have been prevented by something really simple, hindsight is 20/20 and the guilt of knowing that you could have prevented something tragic with your kids is enough to eat a person up and is more than enough punishment when the actions were not deliberate and intentional to cause or inflict injury upon someone else.  |

yea I know their guilt is going to plague them especally if the little boy suffers from any permanent disability that occured from that day. Another thing that they could do is install one of those child gates in the doorway those can be stepped over and would keep any little kids inside.  |

A fence is great. Also if its a must signs all around it on four sides with lights on it. And the back door shouldve been locked. But stuff like this happens. L:ucky the kid lived.  |

I am sure that they will be thinking of a thousand different ways to prevent something like that from happening again. Like I said I have been there before and hindsight is 20/20. There are many cases that you go...well DUH that is obvious and they should have known to protect from that, others if you are willing to admit it to yourself you go....."WHOA I never even thought of that happening." I don't like to make assumptions or accusations about accidents that can and do occur with children. I know that I am a good mom and it has happened to me. Even little Carrie Ingalls wandered away and fell into an old well and the Ingalls were the cream of the crop when it came to parenting... ..LOL  |

LOL @ Az yea I suppose so...This happens all the time here though...this is not just a freak accident. During late spring all summer and early fall it seems like there is at least one incident every single day. I read somewhere that drownding(sp?) is one of the lead causes of death for kids here in Florida.  |

the house MIGHT not have been the child's parents... i agree the pool ANY AND ALL POOLS should be fenced off!! kids expecially young ones can sneak away soo quickly... you don't know if this child was left in the hands of a babysitter or anything so you can't point the finger at the parents over things(like door buzzers what they probally wouldn't have heard of it was a party if they had a babysitter and it wasen't thier house) i don't blame the child but i don't place all the blame on the parents...  |

I found several sites that list drownding as the leading cause of accidental death to children under five. Not sure exactly on the exact statistics though will do some more research on that  |

well the homeowner isn't exactly liable either...they can't control children... young children it's a situation where there should have been a babysitter... for example Tommy Lee had a party for his son.. a pool party... a child drowned... he wasen't liable... the person who was... the nanny who was highered for the child... the home owner(tommy lee) did not know this child didn't know how to swim well... but he didn't have a lifeguard on duty either... it's unfortunate and horribly sad that the child lost it's life... but they tried to sue for millions.. when it was thier nanny who niglected thier child and left the party to go to a casting call.. acting a random person to keep an eye on the child...  |
