Another Update on us Being SUed...YOU WILL NOT BELIEVE THIS~~luv_4_2pac~~

OK I am really peeved right now...first of all our insurance company refused payment on this woman's injuries back in 2001 and she wanted 10,000 dollars. They offered 3500. Second of all she had an accident in 1997 apparently and had injuries in that accident so apparently we are supposed to pay for that. We have an attorney now but since our reply to the case was sent in on June 24th and that was the last day well the clerk did not enter it til the next day so effectively we are screwed unless our attorney can get a judge to believe it was entered on that day. Lastly the woman in question is claiming she has neuropsychological damages. I mean what the heck is that? She had an MRI done but only 3 months after the accident. The accident occured on November 16 and she waited until the end of February to get treatment? Well if you dont count the emergency treatment that is. Now I have no doubt this woman is just out to get the most amount of money she can for herself who cares that we have three kids and that my husband was not even at fault for the accident who cares that she was stopped on a major highway with traffic moving all around her and now she denies that fact. Oh man I am so angry. I actually felt bad for her but obviously she is just out for as much money as she can possibly get. That and the fact that if our stupid insurance company had just paid what she was asking to begin with we would not even be here now. But now she is saying our maximum coverage is simply not enough.....AGGGGGHHHHHHH

Date: 6/30/2003 12:47:00 PM  ( From Author ) From Authorid: 53900    Here is what the papers we got in the mail say she was treated on 11-16-01 then waited until 2-14 to seek any more treatment and her last treatment with this doctor was 3-05-02. So what is that like 2 maybe three weeks? And it was over three months after the accident?

Or she walks with a limp or has severe back pain etc. If she does.. maybe you can contact your lawyer or insurance company and see if they have hired a detective to make sure she is suffering as she says she is. Sometimes they lawyer or insurance company does this on thier own, but sometimes they rather just pay whatever and get it over with, with little fight. So people get away with lying and claiming something that isn't true. By the way, was she in her car when she was hit or was she standing in the road or something. God Bless  
Date: 6/30/2003 12:57:00 PM  From Authorid: 57404    I'm not taking her side or anything. lol But I do know that sometimes the effects of an accident may not show up as a problem for a few weeks or possibly months after an accident. I'm not a doctor but I'm just speaking from experience from being a car accident. My doctor told me I would be sore for a couple of weeks. Well, after a few weeks, I was still feeling what I thought was still sorness and passed it off as such, then a couple more weeks went by and then I went back to the doctors and found out there were muscles ripped in my lower back.
So lawyers try to drag out cases, since this type of thing happens to make sure the person gets everything they can out of someone. I had a freind who was with me in the car accident and she dragged it out. Me, I just wanted the medical bills to be paid so I settled when I knew it covered the medical bills. I wasn't interested in pocketing money for myself. However my friend was, and I stopped talking to her after this. I heard she was investigated and busted but I am not sure if that is true or not. I really hope it all works out.. it sucks and hopefully she will get nailed. God Bless
  
Date: 6/30/2003 1:01:00 PM  From Authorid: 16845    I'm sorry that this is happening....but I do have to say one thing about the MRI...sometimes with accident if it's a 'non' ememergency type thing it CAN take three months to get an MRI done....because it has to be approved through insurance even an emergency one can take a few days to a week to get done...etc...so I just wanted to say that Because I have BEEN there... good luck with the case..  
Date: 6/30/2003 1:23:00 PM  ( From Author ) From Authorid: 53900    Yea thats true...I guess she may have had to wait for treatment but three months just seems like a long time and then there is the fact that she was in another accident before this so more then likely she had injuries which could have been aggravated. I dont know what to think about this the attorney said it would take til September til we could get into the judge for the court hearing on why the reply was not entered earlier and that teh plantiff's attorney would make it seem like it could have been entered earlier plus I guess it was not in teh right form. Our insurance company ignored our phone calls and finally called us on the last day that we had to make teh reply my husband went ahead and did that he is not an attorney so of course it is not going to be in the correct form.

She was bringing home my other daughter and two of her friends that were spending the night with us here. This was the first time I had ever met these girls. They were hit broadside when turning left and the patrol went through the light. They had to use the jaws of life to get them out. My daughter driving only suffered shock, my youngest daughter suffered severely,multiple breaks and permanent nerve damage.We got sued by the other girls parents and they only had minor injuries and it wasn't my daughters fault. Of course they sued the city and LOST and thet came after us for 100.000 and the other for 80.000. Our insurance offered them a settlement and they refused it. We drug it out and dug up dirt and they finally accepted the insurance company's offer. They played the part of injured very well and it took two years to settle this. We had them watched and pictures taken of dancing and etc by their friends and the case was going to trial. When we had a hearing they decided to get what they could and run. I wanted it to go to trial. I learned a lesson from that though. I never let any other of my kids friends ride in our cars as long as we were in charge of them. You learn as you go. I will tell you that the judiscial system sucks. The city got out of paying any of us anything. We only wanted what the medical bills cost us but we didn't get it. I still get mad that a police lady can run a red light and almost kill four people and they don't have to held accountable. The only thing they did was fire the officer! We live in a small town and thats how things go around here!

If you don't feel you are getting what you should from your lawyer, get another one! If you feel your insurance co is not doing what they should, see your state insurance commissioner. Fight for your rights!  
Date: 6/30/2003 6:31:00 PM  From Authorid: 27046    Well I beg to differ with 3 months of waiting for approval for the insurance company to cover the cost of an MRI, however it does vary from state to state. My son having just been hit by a car 6 weeks ago is covered under Ny state no fault insurance. Any and all bills related to his vehicular injury are paid for by the auto insurance company, NOT personal health insurance. They do not and will not pick up the bills. I STILL have a $160 medical bill that I am being sued for from when I had my accident because the insurance company denied it and my own private health insurance wouldn't cover the cost because it was a medical bill from injuries sustained during a motor vehicle accident which falls under car insurance jurisdiction. Accidents are a touchy subject for me because I didn't do a single thing wrong and lost my brand new car and because I didn't meet the threshold for serious injury defined by the law in the state of NY, I couldn't get any compensation for my injuries. Not even for the few weeks that I was bruised, cut and battered. I wasn't compensated for my vehicle either. Car insurance is a JOKE and serves absolutely no purpose other than to rob you of money.

The insurance company could have settled this a long time ago and she was willing to settle for 10000 to begin with but tehy just wanted to save their money even though we have been paying them like 80 a month for the last 6 or 7 years. Heck that would almost cover what she wanted but no they had to piddle around and now she is suing for alot more. Like I said I am very p'd off at teh insurance company too.

IF insurance companies made it good practice to simply equally and fairly compensate a person for their injuries, they wouldn't find themselves in a high end lawsuit resulting in million dollar settlements. Using my accident as an example. I was not seriously hurt, I was sore, cut up and battered but nothing was broken and I have no lasting damages physically. Emotionally it has been a havey weight. There has not been one single day that has gone by that I have not spent at least 5 minutes being angry, bitter and resentful of how I got the raw deal when I was the victim driving along, minding my own business and following the laws of the road. I was driving a 97 with 43,000 miles on it and now drive a 91 with 178,000 (169,000 when I bought it) Like anyone else I contacted an injury lawyer and the woman told me that she has told insurance companies time and again...if you just compensate people equally for what they lost you would put me out of business...Now they gave me $3990 for my car. It was $4400 to repair it, they could have junked my car bought the same exact make, year and model in a different color that I found two weeks later at the same car place that I bought mine for $4,300. They could have transfered the amount left on my loan for the first car, over to the new car and left me to pay the last $1200 I had left and they could have paid the other $3100. No they gave me $2700 to buy a hunk of junk on the side of the road. If he had simply broken me finger you bet your bottom dollar I would have taken him to the cleaners and slept soundly at night because in the end they sure don't care what they do to you.  
Date: 6/30/2003 7:26:00 PM  ( From Author ) From Authorid: 53900    Yes Az I talked to you about it in your case I agree with you but in this situation my husband was not to blame "technically" but since she claims she was not stopped on the highway where she was not supposed to be he is being held responsible because he reaqrended her. Who cares that some guy cut him off and then fled the scene even though he essentially cause the entire accident. Who cares that she was willing to settle for 10000 a few months ago but now suddenly her damages far exceed our insurance? Who cares she had an accident prior to this that very well could have contributed to this accident? She is getting far more then she deserves in my opinion with 10000 dollars. ( This is not directed at you BTW Azairyia I am just really frustrated at the insurance company and at her)

If you haven't already, write everything - dates, times, conversations with anyone of importance - lawyers, "victim" and your insurance company. Insurance companies are bonded and part of the premium you pay pays for this bonding. Therefore they should have their lawyer defending your husband. I don't like lawsuit lottery, but consider threatening to sue your insurance company for any loss on your part in regard to this woman. Hope it works out.

I still suggest that you hire a private investigater to video her is she claims to have some physical handicap. I really believe this woman is a fraud.
