It's exactly what they had in mind, people just don't understand the true meaning behind it they always use it out of context. People are in fact when arrested presumed to be guilty and that's why they are arrested. If no one was ever presumed guilty no one would ever be arrested. The innocent until proven guilty applies only to the sentencing phase. Meaning a person cannot be sentenced for a crime unless proven guilty of the crime, and that the prosecution (government) bears the burden of proving the person guilty beyond a reasonable doubt. |

Base, jail time is supposed to be the penalty for those who are guilty. Why is it that those who have yet to be proven so are subjected to the same sentence? That is NOT right by any standard. |

They aren't subjected to the same sentence and when they are sentenced time already served is taken off the sentence. I understand you're frustrated because of what you're going through but are you in jail right now? No, you made bail, most people are in front of a judge pretty quickly after being arrested. Bail serves a purpose, it's an agreement that if you show up you get the money back, if you don't the government keeps it and a warrant goes out for your arrest. Would you like murderers to be arrested and while awaiting trial back on the street to kill more people, or rapists? The more serious the crime the higher the bail or no bail is granted. The less serious the lower the bail and a lot of people who don't have prior records and are not arrested for a serious offense are released on their own recognizance. Other countries you can be arrested and sentenced without a trial, considering that, I think our system is pretty fair. If you have a better system, I'd like to hear it. |

No, Base. I had to pay a hundred dollars that I really didn't have and it will never be refunded. The most I can hope for is that they'll just tell me to go home and forget it ever happened. There are no apologies for ruining lives and no reimbursements. Don't ever run outside of the law or even look like you're doing so because you WILL lose. |

with him being SUCH a high profile person he might jump the gun a little but take a look at robert blake...he is sitting accused of killing his wife... OVER 2 years ago.. he was held without bail for 2 years... in ISOLATION none-the-less (if you have ever been stuck in a small room for a long period of time with only an hour outside a day you would probally go a little batty.. i think most of us would) and after more then 2 years they have finally given him bail and on house arrest... yet look how quickly they processed Wynona Ryder for shoplifting |

You're right Frank, sometimes the legal system does not work or is unfair and it's pretty scary. I'm going to tell you my own little story here. It's not as troublesome as yours but it's something that has me upset as well. The day before yesterday I went to change auto insurance and they ran my liscence and I was told it had been suspended. I had no idea why. So the agent did a little check and lo and behold it was for a ticket I got last year for having a loud muffler. This was a matter that I resolved quickly by having it repaired, contacting the DA and getting the case dismissed against me. Fortunately I still have the judges letter saying it was dismissed. I was told by the agent that with a suspended liscence they would not insure me, they would not register my car (which is also due) and if I was caught driving they would impound my car. I was shocked because I had done nothing wrong and all of a sudden I felt like a criminal and I was scared. I went to the DMV to straighten it out and apparently the court had not sent my dismissal to the capital. Not only was my liscence suspended but there was a warrent for my arrest. I felt like I was in the twilight zone. For having a loud muffler of which I fixed and did everything right and legal there was a warrent for my arrest because of a paper mix up???? It's going to take some time to straighten this up but in the mean time I'm nervous that I'll get pulled over and hauled off to jail because of this stupidity. It's scary to think our lives are in the hands of such incompetents. Good luck with your case. It's a shame you have to go througe all of that. |

It's a shame that our justice system can't be "human factor proof" I wish it were. Just a couple questions Frank, were you given a Blood Alcohol Content Test (breath test) if so what was the results? What is your states illegal per se? You mentioned tranquilizers and two drinks, I'm assuming (I know I shouldn't) that they were injested at least 8 - 10 hours prior to driving your vehicle, which would mean you don't believe you were under the influence of either? Inquisitive minds want to know... Have a great day. |

GW, about fourteen hours or more had lapsed since I had the tranquilizers and about 3-4 hours had passed since I had the beers. I'm 5'11" and weigh 160. The limit here is .10. There is absolutely NO way that I was impaired in any way. |

GW, to answer your other question, I was not offered a breathalizer test. The officer requested that I submit to a blood test and told me that if I refused, I would lose my license. I saw no choice but to comply. The blood was drawn at the hospital and, supposedly, what is taking so long is waiting for the results to come back from the lab. If they had just let the hospital do the test, the results would have been back in a couple of days. Instead, they sent it to Nashville to the TBI (Tennnessee Bureau of Investigation) so that they could analyze it. That's what's taking so long. I feel like a common criminal and I haven't even done anything. |

Why they sent it to the lab in Nashville Frankie is because it was probably tested at your hospital first and found negative. Now, the cop is trying to cover his butt anyway he can because he stopped you and subjected you to some things perhaps maybe he should not have. Now for some advice from me: Contact your ADA (American Disability Division) and your Civil Rights Division because your civil rights have been violated. There is no reason to keep this dragging on this long, Frankie as they can do a DNA on a corpse faster than your ABC is being run. Go get them Frankie. |

Hang in there, Frankenstein! Do not understand how they could even charge you without a test. Actually, that was one of my greatest fears - am 71 years of age and absolutely could not walk a straight line to my car! Finally a dear family member insisted I see a Palmer Method chiropractor (had backsurgery 50 years ago). It worked - can walk a straight line. Episodes of vertigo have gone away - but, had gone to chiropractors several times, but nothing worked. Evidently "Palmer" methods do for people like me. RAT |
