I Have A Question And I'm About To Explode.......*CC*

As you know...Mike and I got an apartment, and we already paid deposit on it. So now we are only waiting for a move-in date...WELL....Mike has been calling the apartment manager everyday for 2 weeks now, and the son of an onion is playing the run around game on him. Everytime Mike calls he's either not in his office,he's out somewhere, or he isn't accepting calls. Both Mike and I are getting tired of his run around games and we want a refund on our deposit so we can go to a more respectable apartment complex.

So my question is......

Mike said he signed a contract with him, so i fear he won't be able to get his money back from them. Are we able to get a refund on our deposit since we do not want to live in that apartment anymore?

And besides isn't the contract only valid if you are living in the apartment? You tried to move in but the landlord is avoiding you so wouldn't he be breaking the contract?

If you have signed a lease, it should have a move in date stated somewhere on it, if this time has passed and the manager has not allowed you to move in, he has broken the contract and yes, you can get your money back.
