not intended for young childeren, might give nightmares. but this story is so heartbreaking. i cant believe these men could be so cruel. this just about brought me to tears.
Scruffy was a 12 year old Yorkshire Terrier, whose life began and ended with abuse. As a puppy, Scruffy was abused and shuffled from home to home. After a period of time, he went to live with a caring family, the Whitmire's of Kansas City, Kansas.
The Whitmire's took Scruffy in after hearing about his abusive past, and decided to give Scruffy to their granddaughter. It seemed as if Scruffy was going to be able to live out the rest of his life in peace, in a home where he was loved and well cared for. He now had the love of a little girl who wanted nothing but to love him and play with him, and it appeared Scruffy's nightmare was finally over.
Scruffy enjoyed his new life and the love of this little girl, and she grew up and eventually had a child of her own. Now Scruffy's life was complete, he was the cherished pet of a family, and had everything a little dog wants and needs to be happy.
Unfortunately what happened next was worse than anything anyone could have imagined.
June 27, 1997 was the day Scruffy is alleged to have met with Jose Gutierrez - age 17, Marcus Rodriguez - age 18, Richard Golubski - age 20 and Lance Arsenalt - age 21.
This is the day Scruff's nightmare began and eventually ended with his murder.
Jose, Marcus, Richard and Lance were neighbors of the Whitmire's granddaughter, so Scruffy was familiar with these men, and did not have any fear of them. The following is the story of how those four young men allegedly decided to spend that summer afternoon.

Jose, Marcus, Richard and Lance are accused of obtaining a video camera, pressing the 'record' button, luring Scruffy from his home, and then torturing and killing him in an unspeakably monstrous act of cruelty.
In the videotape that the police and media have in their possession, four men are shown torturing and killing Scruffy in lurid detail. The quality of the tape is very good, and the police have been able to obtain photographs of the men in the tape.
In this tape, one of the four men is shown to elevate Scruffy off the ground by the neck, and then begin this horrific abuse by choking him. This 6 pound little dog did not have a fighting chance against these men. Scruffy, still alive, was then placed in a trash bag. The four men shown in the tape then doused the trash bag with what appeared in the video to be lamp oil, took a cigarette lighter, and set Scruffy on fire.
Scruffy, at this point in the video, began to run wildly in pain and agony around the trees while the four men watched and laughed. When the flames finally went out, Scruffy was still alive, but his torture was not over.
Next, the men decided to try to decapitate Scruffy with a shovel. After slamming the shovel into Scruffy's neck and not being able to attain their goal, they realized that Scruffy was more of a fighter than they had expected. The men then opened Scruffy's mouth and began to pull his jaws apart, as if trying to rip his face in two.
Using the shovel in place of a club, the men then beat Scruffy until his tiny body gave out, and he died.
Throughout the videotape the four men are all shown laughing and having a good time as they are carrying out these unspeakable tortures.
One of the most tragic and heart-rending aspects of this entire tape was Scruffy's undying trust of these men, his murderers. Each time that they would hurt him he would run away, only to turn and run back to them for help and protection from the very abuses they were subjecting him to!
The men then allegedly decided to make copies of this obscene six minute videotape, showing the barbaric torture and murder of this tiny pet, and distributed these copies to their friends, to be enjoyed over, and over again!
The Whitmire's granddaughter became very worried about Scruffy and she and her family began to search for him, enlisting the help of Jose, Marcus, Richard and Lance, the four men accused of Scruffy's torture and murder. If the allegations are true, then they only pretended to try to help their neighbor try to find her lost dog!
Their search for Scruffy naturally proved fruitless, as poor Scruffy had been the victim of this horrific torture and murder, and after a period of time, the Whitmire's and their granddaughter began to hear rumors that Scruffy had been killed.
On January 6th, 1998 a courageous individual who received a copy of this obscene videotape of Scruffy's torturous burning, beating, near decapitation and murder, realized that these men should be in jail for what they did. As any moral, conscientious person of compassion would do, the individual turned the copy of the tape over to the police.

On February 9th, 1998 official charges of felony arson and animal cruelty, were brought against the four alleged perpetrators by Terra Morehead of the Wyandotte County District Attorneys Office.

Marcus Rodriguez, Richard Golubski, and Lance Arsenalt were all arrested and held on a $50,000 bond. Jose Guierrez, 17, was a fugitive until February 23, 1998 and rewards totaling $3,500.00 were offered for his capture by The Humane Society of the United states and the Wyandotte County District Attorney's office.
No one can imagine or comprehend the pain and suffering that Scruffy was made to endure. Scruffy himself most surely did not understand why these men were doing this to him. The Whitmire's are heartbroken at the loss of their beloved pet, imagine the horror this poor family has faced in addition to the loss of their dear friend!

In researching Kansas statutes for animal cruelty we learned that it is only a misdemeanor there! Maximum sentence is 12 months in prison and a $2,500 fine.
