Fifth Amendment rights versus Child Protection......By Toro

Here is how I understand the Story: Rebecca Corneau belongs to a religion that has been labeled for the most part a cult . She belongs to a sotheastern Massachusetts group called "The Body". This group does not believe in modern medicine nor do they believe in the legal system.

Three member of the sect were charged in the starvation death of two children. Ms Corneaus newborn son was found buried in a state park two years ago. The Department of Social Services then stepped in and took fourteen children from care of the group.

Corneaus has recently had a baby, or so the State thinks and they want Corneaus to turn over the child to Social Services. Mrs Corneaus claims it is a violation of her fifth amendment rights for her to do so. On the other hand state authorities say that the well-being of the child is paramount.

Here are some questions that I think that this story brings to my mind:

Doesnt the childs rights supercede her fifth amenments rights? Does her belonging to a particular group sufficient cause for the government to step in? Is Judge Nash biased by calling this group a cult?

Date: 2/1/2002 8:48:00 AM  From Authorid: 44850    well, i would have to know exactly what was the justification for starving the children, as far as her having a baby . . . it is unfortunate that she can just not say and 'plead the fith' but if someone doesn't want to tell you, there isn't really a way you can force them, it will have to be a long drawn out process .... as far as the 'cult' thing goes . . . well, according to websters dic a cult is : a system of religious worship or ritual .... so, if 'the body' can find a consecutive way of their methods acting with their beliefs than its an accurate term, HOWEVER, what seems biased and a tad unfair for not knowing anything other than 2 children found dead is the subliminal connotation you think of when you hear the word 'cult'. i would not be suprised if it was just some grown adults that are trying to 'resctucture and give morals' to the kids that may have troubled past .... and if that is the case, their 'religious beliefs' have nothing to do with it, they are just mean, cruel people.

I do not see where her fifth amendment rights are being violated~ the fifth amendment states...nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty~~apparently she believes that bringing the baby forth is witnessing against herself. I dont by her theory.

A person following a religion, needs to stand back if they can,and observe things. Am I free to question,? am I free to come and go as I please? Express a disagreement to anyone wthout reprucussions.
