Tough question on USM copyrights

After I posted my story "Posting entire articles online" and looked at some of the responses, I got to wondering: if anybody were to ever get angry at a USMer for posting their stuff without permission, and then decided to sue because of this, who would get in trouble: USM's staff, or the person him/herself?

I checked out the privacy statement/copyright info at the bottom of every post, which you can find at http://www.unsolvedmysteries.com/privacy.asp , and it states that the author retains ownership of the property, but USM has the right to publish it.

Okay. So, say an author posts a news report, but takes out all identifying info, so it seems like the author wrote it themselves--but they didn't. Then, the staff decides to write a book, a compilation of great USM stories. They put our author's in, without realizing it is copyright infringement.

So then, who would be prosecuted? The author, or USM staff?

Date: 1/25/2002 8:16:00 PM  From Authorid: 12133    the author..its called plagarism..USM assumes that any material posted is original, or at least credited to the correct author..not givng credit is a copyright violation...if I have a band, and I play "Knockin on Heaven's Door" we, technically are supposed to send the song writer money for playing it.

But (while not assuming any sides--I don't know where I feel yet), would not USM have at least some responsibility, since they have demonstrated that they regularly patrol the site and delete material that does not agree with the rules? If they were to publish this book, they would be saying they did not research it, and they would be adopting responsibility since they are the ones who put it in print.  
Date: 1/25/2002 8:22:00 PM  From Authorid: 18870    I would have to say the Author, cause if they don't say it was from someone else and if someone on USM dosn't happen to read it anywhere else, then how would they know it wasn't the authors? So I don't think they should be at fault.

If a person posts a story that was in fact written by someone else, but passed it on as their own, then it would be solely the responsiblity of the Author. The site is non-profit and since that is the case, they arent responsible for hiring people to make SURE that the story was in fact written by the Author or plaguarized. I think the site would be out of harms way on all of it... They monitor it as good as anyone can possibly monitor it, and they are volunteers for the site... NO ONE gets paid to check everything out. When an Author posts something and doesnt name another person as the Author, then they are making the staff and members THINK they wrote it, and it is their baby... not the sites...
