Doctor charged with murder in drug death

WEST PALM BEACH, FLA--- A Jupiter doctor accused of improperly prescibing the painkiller OxyContin has been charged with first-degree murder, racketeering and trafficking a controlled substance. The charges against Denis Deonarine,56, were part of an 80-count indictment that remains under court seal. Deonarine was charged with killing micheal labzda, 21, of Jupiter, a patient who died of a drug overdose on Feb. 8. A handful of other doctors across the nation have faced or are facing the charge of manslaughter on similar cases. But Deonarine could face either the death penalty or life in prison without parole if convicted on the first-degree murder charge. State Attorney Barry Krischer said that other defendants remained at large in the case. Richard Lubin, Deonaire's lawyer, said the murder charges were inappropiate, given that alcohol and other drugs were found in Labzda's body, indicating the young man had abused drugs. Meanwhile, Labzda's family has filed a civil lawsuit against Deonaire, the pharmacy that filled the OxyContin prescription and the drug manufacturer, Purdue Pharma. OxyContin has gained controversy in recent months as the number of overdose deaths has grown at an alarming rate. recreational users of the drug have come to value its quick high when tablets are crushed and inhaled or mixed with water. Florida recorded 152 deaths attributed to overdoses of OxyContin and other morphine like prescription drugs in the past six months of 2000. The U.S. Food and Drug Administration strengthened the warnings and precautions section on labeling for OxyContin.

**i don't think that's right...i mean it wasn't the doctors fault the kid OD'd..i mean just like they said..there was alcohol and others drugs found in his system..so maybe it was an accident..

what do u guys think??...should the doctor be charged??

Date: 8/12/2001 9:47:00 PM  From Authorid: 12341    This is the Exact Reason so many Docs are stopping pain meds, most patients, even some cancer patients are being given pain meds only through pain clinics here in this area. Most of the time abusers are known to Doctors and Nurses, it becomes eaasy to spot chronic complainers who are looking for drugs to abuse. Too bad when this happens because it raises a Red Flag to all Docs, be careful what is given and how much.  
Date: 8/12/2001 9:58:00 PM  From Authorid: 7654    I don't think they have a very strong case unless they can prove that the docter knew that he was also useing other pain medications and alcohol.However most docters can tell about this.My ex is hooked on this medication (oxy contin) and other pain killers and alcohol..He has been kicked out of four docters offices..And now he has found another one to give them to him..

Date: 8/13/2001 9:32:00 AM  From Authorid: 25438    If he perscribed the drug for a necessary reason than this is all stupid. His parents just refuse to believe there little boy was a druggy. If he was mixing alcohol with oxy's he was asking for it. Its not the dr.'s fault.
