Free Heating Oil [[[[[ Coast2CoastAMfan™ ]]]]]

My grandmother lives in a big house that was turned into apartments. One on the bottom floor and one on the top floor. My grandmother lives on the bottom and a woman lives on the top. I guess for people struggling with the costs to heat a house, there is this 1800 number you can call to get 100 gallons of free oil. Well the woman living on the top floor got the 100 gallons of free oil, but is insisting my grandmother pay her 400 dollars for it to be put in. Is this legal? Is that considered reselling fuel? She just totally kicked my grandmother out of her apartment and now my grandmother is all upset, saying she cant even afford 400 dollars. And I know for a fact its against the law to do what this woman is doing, but id like to have a few second opinions, possibly from a lawyer judge or cop?! Thanks so much. And again I could be wrong but Im so thinking this woman is rediculous! And Im going to see to it that my grandmother doesnt have to pay 400 dollars to this woman for free fuel to be delivered to this house!!

Date: 1/29/2008 12:48:00 AM  From Authorid: 52546    Yes what this woman is doing is illigal and if ur grandmother is undercontract to live in the apartment the lady can't kick her unless your grandmother breeches contract. If I was in this situation i would contact a lawyer and discuss with them what this lady is doing.
  
Date: 1/29/2008 2:10:00 AM  From Authorid: 10657    Well, I am a little confused here so you might have to clarify for me Okay when you say kicked out does that mean that she has been evicted? What was the reasoning for the eviction? Are you sure that the oil was free? Do they not have seperate heating units? I don't think it can be resold it is meant for persons with low income or no income. I would call the 1 800 number and report her provided you have proof that she is trying to resell it. They will handle the situation from there by investigating it would be my thought If, she has evicted your grandmother and your grandmother has not breached the rental agreement then get a lawyer. However, be aware unless, tenant landlord laws have changed if, she pays rent on a month to month basis the landlord may kick her out, ask her to move, or evict her at anytime. I used to do month to month leasing until, I got booted out of several homes because, they were allowing family to move back home. Good luck!!

My grandmother went upstairs to try and reason with the woman,and the woman kicked my grandmother out of her apartment. in other words made my grandmother leave to go back to her own apartment. There are not 2 seperate heating units just one.
